Wedding Trouble

Hi,
I just want some advice or help from anyone in the same situation. 

My hen do is booked for 18/06/21-21/06/21. It’s a big house that will hold 20 guest, all coming from different households. 

We have contacted the venue to move the date as going by government guidelines we now can’t go however they are saying we still can attend and they are unwilling to move the date or give out money back. 

I really need advice on what my legal rights are and what I can do and I don’t have the money to reimburse everyone and we won’t break the government guidelines.

  • Could be tricky.  I assume you've booked and paid for it yourself?  What exactly is the nature of your booking?  Did you specifically ask to book it for a party of 20 guests?  Their argument is presumably that the place is still available to you, which it will be on the dates in question.

    Did you take out any sort of insurance?
  • The problem is hospitality will be open then, and your household configuration isn’t the problem of the vendor.
    I hate to say it, but this will be one for insurance - the owner doesn’t have to do anything.

    It’s for my hen do so the house itself was book through a hen do sight. So they are aware that everyone doesn’t live in the same household. But they just keep saying it’s fine to come. But legally we can’t as none of us live in the same household. Unfortunately my sister has arranged this for me but not taken out insurance 👎🏻

    I thought that maybe because it is sold as a 20 person hen party and contract we’re signed to state this that because the government won’t allow it because of mixed households we mount have some legal right to move the date

    I haven't read the new rules in detail yet, but this is some time away and it's possible that the rules will change anyway.  This might fall under the frustrated contract category if they are not legally allowed to host you, but others will have a more informed view on that.

    Ultimately, this is for your sister to sort out,  she holds the contract so she needs to be the one dealing with them.  Who did she pay?  The house owner or the website she booked it through?

    She paid the website and they have told her they have now passed all the money to the house owner so we can’t have our money back and will not move the date.

  • Ok, so as a starting point, the only two parties who can sort this are your sister and the website she paid. The venue don't have to deal with you or your sister, so best to focus your efforts on the website. 

    I'd be checking the rules very carefully as the date nears.  If the house can lawfully be occupied by your party, no refund is due.  If it can't be, then that's the time to consider action via your sister's credit or debit card (assuming she paid that way).

    So it was booked back in 2019 then rescheduled in 2020 for June this year

    Hopefully the rules change but I assume the government are going to stick to their plan which would mean lawfully they can’t house 20 people from different households. Well just have to hold on a bit longer I think.
