Awesome stuff guys, ur unappreciated.Particularly by the private parking sector! 😆Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

It's a legal case , so what do you expect ? Show me one legal topic where the whole thing can be seen on one side of an A4 sheet of paper , plus how do you think that tens of thousands of lawyer's make a living ??wilson111 said:Wow okay. Awesome stuff guys, ur unappreciated. Will spend this evening and tomorrow looking at all this info. It's all a bit overwhelming
You could employ one , at great cost , or take the d I y approach !!
If you do the latter , you take on that burden of learning in order to represent yourself , this is your court case , so get off the fence !! It's not going away !!3 -
Point taken. Im on it. Again thank you for all the advice. Also I know this is probably not of any help as i have already admitted I was the driver but I sold that car many moons ago.
Also Umkomas I take your point. But CEL are obviously unaware of this and to them I was picking up a friend not just having lunch. Its reasonable to assume you would be in a hotel car park to pick up a friend.0 -

LOL Umkomaas, everyone likes to be unappreciated.....
But to put my two pennorth in shouldn't there be a grace period of minimum 5 minutes or is that too obvious?0 -
Well in the searching I have done it seems there can be up to a 10minute cooling off period. Isnt it just completely unreasonable to request such a fine for a 1 minute overstay?0
-
Yes couldn't agree more but PPC's are not known for their reasonableness. It works out about £16,250/hour - nice work if you can find it!
I am relatively new but I saw the lack of grace period and was hoping one of the more experienced people could answer that more conclusively.

It's not a fine , it's a parking contract breach , the 30 minutes probably trump's any grace period given in the relevant BPA CoP at the time , but feel free to download the correct version and read clause 13
It's not us you need to convince , it's a judge , but the picking up a friend is more plausible than just Trespassing whilst eating food
Selling the vehicle later is irrelevant , it was in your name at the time plus you admitted to being the driver , so paragraph 2 will take 2 minutes to type
Then work on paragraph 3 , set the scene and add defence arguments , based on your story

Emailing a SAR to the DPO at CEL attaching a copy of the claim form as proof of I D under the GDPR law1 -
For the SAR? I assume I'm using the first template on the thread. Or is there an updated 1. Or is it better to do it in writing requesting my details not be given out.
I apologise for my amateur knowledge of this whole situation.0 -
SAR is covered in the newbies FAQ sticky thread near the top of the forum , it is up to date
The usual SAR is the legal beagles one , nothing to do with parking , it's a data protection issue
Email it to the DPO at the PPC involved , so in writing ( obviously !! ) , There is no oral option !!1 -
But you weren't, so it's rather a moot point. But are you sure that you were not required to input your VRM into a tablet within the hotel, or even a ticket machine on the car park? What did the signage say? Oh, sorry, you didn't see it. Isn't that a learning point for the future? Because all their 'nab ya' conditions will be detailed therein.wilson111 said:Point taken.
