    Are you sure the word "penalty " was used?  If so that is a serious breach of both ATA's codes of practices and should be reported to them.

    Thanks for all the info and encouragement. OPS has started to "monitor" our parking while we await for MA's reply. Residents are very annoyed that every time when OPS is here, they park in a way that's blocking residents' garages, one rule for us, another for them. 

     Large majority of residents and leaseholders signed the rejection letter. However, if the reply is unsatisfactory, what are other actions we can take? Will getting a solicitor to write the letter be any useful if we are to take complaint further up to director of the MA or The Property Ombudsman? Is it expansive and difficult to take out injunction?

    A solicitor letter may be enough. we cannot know this, we are nto the MA
    I would be suing the MA, each and every time the lease is violated.

    I think in Roger Davey v UKPC he took out an emergency injunction for a few hundred quid and got his solicitor to claim all his costs straight back and to warn the PPC not to trespass on the land again.

    IMO he let them off lightly, he could have gone the data abuse route.

    Residents should be taking photos of the offending scammer's van blocking the garages and forward them to the MA, each and every time it happens, asking what they are going to do about this persistent offender they have employed.

    I'm not sure which way round it is, but either stopping someone from getting into their property, or perhaps it is out, is an offence, and the police can be involved, so photos should also be passed to them.
    Again, I'm not sure which way round it is, but you are permitted by law to move a vehicle blocking your access, even if it involves causing minor damage such as breaking a window in order to release the brake.
