     It was advertised to come with a 12 month MOT upon sale.
    During the next 12 days the car failed its MOT twice but passed on the 3rd attempt (12th day). At this point we decided not to buy it.
     Since they put it through am MOT, did you agree to buy it, then change your mind after 12 days?

    You have proof that you were informed that the deposit was refundable so depending on the payment method, you could pursue a chargeback or in the case of a credit card payment, a "Section 75" claim.

    Sorry, it was paid by visa debit bank transfer on my phone.

    So did you enter your 16 digit debit card number to pay the retailer or did they give you their sort code & account number.
    Makes a massive difference to options available to claim money back via bank.

  • Absolutely move to court proceedings. There's little point in sending a LBA and not following through with it.


    Totally agree, I was wavering a little and just wanted to have other opinions.

    I know its not really pertinent.
    However why put a deposit down on a cheap old car and be waiting 2 weeks?
    I understand if its a car you would get in a day or two but If there was no rush then I would be looking locally.

    I never agreed to buy it.
    Paid the deposit so I didnt have a wasted journey to arrive and find it sold. But that never happened because I didnt go to view it.
    12 days after paying the deposit it did pass the MOT.

    I got online banking on my phone app. They text their sort and acc number. I sign in on my phone app and pay the £200.

    That's a bank transfer. It's a good as giving someone cash as no comeback via the bank.
