However, you got your other costs due to a course of unreasonable conduct, not just them not turning up. So there was more to it. But would you get those costs again at a new hearing? That's the gamble. And they can certainly re-file a fresh claim.
I agree. You or I might fight this all the way, but it is the OP's time and money, so it is entirely up to them to decide what is the best course of action.
If the OP took the £425, then fought a new claim and lost, it should cost them no more that £175 - £200. In other words they would be out of pocket by somewhere between a fiver and thirty quid.
It will have cost the PPC and their legals a lot more than that, especially if a warrant of control was issued.
Like I said, I would be up for the fight, but it's not my time and money we are dealing with here.
