is it worth drawing the judges attention to this tomorrow?
Of course it is, ask for a postponement..You never know how far you can go until you go too far.0 -
Job's done, case over, cracking win for the OP - see post immediately before yours.D_P_Dance said:is it worth drawing the judges attention to this tomorrow?
Of course it is, ask for a postponement..Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Great result and also a helpful judgment (albeit only at county level) confirming my "take" that if it is agreed there is failed service, it follows that the claim is dead.6

Yes precisely. It was like the judge was reading directly from your posts! So helpful, I can't thank you enough.Johnersh said:Great result and also a helpful judgment (albeit only at county level) confirming my "take" that if it is agreed there is failed service, it follows that the claim is dead.4 -
Brilliant news - CONGRATULATIONS - this is a real result for you!
Which Judge and court, please? A great decision.
Now the case is over, can you show your documents here on the thread (redacted of your data); it will really help newbies with set asides, especially what your documents said about the 4 months thing. I don't think we've pushed this enough thus far and we could use your docs as a shining example!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Sure thing. In the county court sitting at Norwich with DJ Spencer. I'm guessing there's no way of attaching the full PDF so I'm attaching photos rather than copy and pasting just to help people with formatting (which I really struggled with!). Not saying my way is 100% correct....but it seemed to go down well with the judge.
