Consideration period is fluid and dependent upon the facts of the car park, how clear the signs were (or not) and the 5 minutes thing is an arbitrary short period the BPA only added to the CoP in 2020 and the Government is set to bin that.  Quite right because that change was an anti-consumer embarrassment.

Thanks for the advice so far all!!

I’ve finished my draft, will number the contents page once approved. Please find a copy on the link below if you could please provide your thoughts:

I’m a little confused around the costs I can claim for. Does this section look sufficient or am I missing anything, paragraphs 17-20 and page 48 in the Exhibits.

Also regarding the Landowner contract, I have not yet received the Claimants WS or bundle. Is paragraph 16 in the Landowner contract section sufficient if I still don’t receive.

Thanks so much guys. I’m hoping I’m not a million miles away from here.

You obviously change #16 to make sense for your case.

Thanks. I havnt seen a copy of the Landowner contract. in your experience would this normally be sent within the bundle with their WS? Our deadline for submitting is Wed 21st July so I suspect they plan on sending last minute.

I may leave paragraph #16 as it is.

If you're going to get a (heavily redacted) copy of the landowner contract, it will be as part of their WS, probably very late on. @Fruitcake normally gives advice on heavily redacted landowner contracts.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Thanks for the advice, hoping the rest of my WS looks OK and I can just amend that paragraph according if need be.
  • Morning everybody. I’m due to submit my WS on Wednesday at the latest. Are you able to please review my final draft and advise if all looks ok to you. You may have to download from the below link.

    Would be much appreciated.

I can't get that to open fully, not sure why not.

Maybe copy and past the points into a couple of replies here so we don't have to download a file.

It has to be downloaded and pre-view is not enabled.  I (for one) don't do downloading!
