Defence filed, so no need to carry on with the MCOL defence?0
-
Correct , Except it is not filed until the CCBC in Northampton see the email and add it to your file and notify the claimant
Check your emails for an auto receipt reply , showing your email was received , some people have not had this when filing at times when they were closed , keep checking for it
When you know it is there , check for Defence received in your MCOL claim history , then check weekly for mention of DQ posted to defendant, at which point email your completed DQ to that ccbcaq email address
No posting letters to them , no filling in boxes on MCOL either , consider it read only from now on2 -
If you dont get the auto reply, send your email when they are open
You do realise you get two different defence points there? If you read carefull you state
- parked, but thats OK as the Concierge said it was ok
- NOT parked, as per Jopson3 -

I mean not parked as in a parking bay in a carpark, this was not a carpark but a drop off point.
So the concierge gave permission to park over there while unloading.0 -
Then you should say so in your witness statement , to clarify the distinction , but should have clarified the point in that defence to avoid ambiguity1

PARKING and UNLOADING are two very different things in law.
You cannot PARK on DYL but you can UNLOAD, as an example of the difference
Do you now understandf you have two different defence points? The concierge gave you permission to park up
and
Unloading is not parking2 -
