    As far as I can tell, there is no company called Premier Parking Limited who are members of the IPC or BPA.

    Premier Parking Logistics and Premier Parking Solutions Limited are IPC members, and Premier Park Ltd are BPA members.

    What name is on the NTK, as it must (should) be the same as on the claim?

    According to Companies House records, Premier Parking Limited was dissolved in 2016.

    I would be inclined to wait for the LBC/LoC and see what name is upon it. If you get a court claim in the name of a dissolved company you can then complain to the SRA.

    You still haven't told us what happened when you complained to the landowner.

    I've requested details of the Landowner from both and had no reply on this but my bet is they wouldn't care. I emailed my MP and received a response also today saying it's a common incidence with that site and he raised the subject in Parliament in 2017. Whoop.

    They won't tell you who the landowner is because ......... guess why?  

    You'll need to do your own digging.  Here's some ideas for you:

    1. Google searches
    2. If a retail park, check on any signage which lists the on-site outlets
    3. Ask retailers on the site if there is a managing agent
    4. Ask retailers on the site to whom do they pay rent
    5. Contact the local authority and ask who pays the non-domestic/business rate for the car park (some councils have a spreadsheet on their website)
    6. Contact the local Valuation Office and ask if they know. They often have a website which might provide the information 
    7. Contact The Land Registry and for around £3 they should be able to provide definitive detail
    8. Give us the name of the car park, we may have seen other cases there.

  • It's Torquay marina - just looked up multiple other cases found there, it's continual practice - the landowner by proxy doesn't sound interested.
    Is there any merit in complaining to BW Legal / The SRA?

    You could wake the landlord up from their sleep by advising them that you will include them in any court claim.
    No point in talking to BWLegal, their interest is only money to which they waste a lot on unreliable claims which judges don't like ... BWLegal are NOT the bees knees

    If their letter is intimidating which they always are, YES report them to the SRA

    Haggle time;
     Parking company is making demands for money that you do not have to pay them.
     They are taking up a lot of your time in dealing with this, therefore you want them to compensate you for your wasted time ( at a reasonable rate)  as they are wasting your time and causing stress worry etc

  • To all - Thanks for all your help advice - contrary to what the morally right move is, I have sent a letter of complaint to BW Legal and their client to see what comes back - but yes I'm knowing it very very likely won't be favourable either way.
    My point with all this is - yes I can afford to pay a morally wrong fine (I'd rather not of course), because of my individual circumstances in the case of I didn't update my V5c logbook so this would have been a £40 fine originally - right or wrong, and could have at least appealed so a big portion of this is also my error. However the moral actions of these vultures are seen, it physically costs me more money to go down the court route off the back of my V5C error because I run my own business and this directly effects my work. To claim any damages also costs me time and money so it's counter-productive (the damages won't cover time spent). To go to court costs me again money and time, the difference being no money goes to the solicitor/client, but equals more pressure on me personally which I cannot harbour with current responsibilities.
    Apologies with this being counter to any of your advice or sounding overly dramatic, it's purely a practical position I have to take currently.
    I will see what they respond with, possibly attempt to corner a staff member online to 'haggle'. Will come back with what happens so this instance can be used as further info for others. I don't want to ideally advocate this method to anyone else, but it just is the best route for me practically as I've said.
    Massively appreciate the advice and time given here - it has been a big help, even if it doesn't seem like it reading this from your perspective :)

    It is not a fine it is  a County Court claim for compensation for the damage they allege that they  suffered when you allegedly breached an alleged  contract with them.  Use of that word offends us.

    Have you complained to you MP?  
    You never know how far you can go until you go too far.

    You have not been fined.
    while it may be pedantic, its important to understand what private parking charges are.
    And once you get your head round things a little you will see that paying their demands is far far removed  from anything that can be considered moral or indeed right.
