Hello,

I am new to this forum but will do my best to follow the guidance in Sticky's and am quite far along the process so have tried to check what I've done so far against the FAQ's.

I'm also not allowed to post links so apologies.

Please note the defence was given to me by a friend who told me to change certain parts to fit my case as had dealt with a similar situation before but the parking company backed down (from looking at the forum others have also been directed to use this defence but correct me if I am wrong)

1. What happens next? The case has been allocated to Manchester already which is my local.
2. Do I stand a chance? The response I gave was obviously generic and I clearly won't be able to delve into the specifics of it if questioned in court.

Ultimately you can clearly see from the photos that it would be easy to miss that sign and it is the only sign for that specific area of land.

Any help would be appreciated.

    Have a look at the guide to court written by bargepole you will find in the second post of the NEWBIES sticky thread. This is a step by step guide, so you should be able to work out where you are in the process and therefore what you need to do next.

    Meanwhile, I'll have a go at making your images live. I hope you have redacted all your personal details.

    The sign looks forbidding to me.

    The scammers said they deny that you didn't see the sign. The only way they could possible know that is if they were there at the time and saw what the driver did and did not do. There is only one witness, and that is the driver. If the scammers were not there at the time of the alleged incident then they cannot say what the driver did or did not see because that would be a lie

    Is the site part of the residential complex where the defendant lived or is it part of a different site? If the former, what does/did your lease/AST say about parking, permits, PCNs, paying a scammer, and court?

  • There is actually more than one witness in this case as the car you can see in the images behind me is a work colleague who would have also got a ticket (work car so would have just been paid without dispute), unsure if that makes a difference. 

    It is not technically part of the residential complex despite it being what looks like loading/parking for the complex, as far as I can tell it is just an unused piece of land with no markings to indicate what it is other than the small sign I parked in front of.
