Made Homeless during house move due to negligence during solicitor payment

    Hi all,
    I have now been given the keys to my new property! I spoke to my solicitor and they informed me that the money had been found and had been successfully transferred to the seller's account - so I'm really relieved and happy (and thankful to you all for your support!). I've already begun a claim to get some legal support but I wanted to whether I should start the process of negligence with my solicitor (e.g. asking for evidence as to where fault lies) or should I wait until we've fully moved in and completed 100%?
    I've not commented on this thread until now. Others had given advice far better than I could so didn't really see the point in me sticking my nose in, but this thread has bothered me ever since I first saw it! I don't even know you but it's been stressing me out! 

    I'm so happy you're sorted, the money has been found and you have the keys. Enjoy your new home!

    Hi all,
    The latest update is that the money is in a transition back to my solicitor's bank account however they are still unable to locate the money specifically. They are not replying to emails and these discussions are over the phone so I'm having to annotate our conversation to them over email so that I have a record. I'm not sure what other options I have so I have used my home insurance to claim for legal support and have started looking for a more permanent place to live. I still have all my receipts and invoices of all the costs I've incurred so far including storage, clothes, and food.

  • Fantastic news!! I haven't posted as haven't got anything useful to add and didn't want to clutter up your thread, but just wanted to say I'm really pleased to hear you are now in your new home.

    I would suggest getting in, getting organised and then getting your compensation sorted.

    I think it is best to lodge the complaint early.  Ask your solicitor's firm to investigate and present you with the findings.  Then escalate when they bodge that up as well.

    Did you need a mortgage for your purchase?
    If so, I don't know if you can claim for the interest you have been paying whilst not having the keys to the property.
    Perhaps another poster can advise?

    Fortunately completion was only delayed by 2 days. Whilst nail bitingly ahonising for you financially that is only 2 nights hotel costs, removalists costs and late payment fee to the vendor.  I doubt you will be able to claim more, it seems to have been human error which was quickly resolved, we all make mistakes sometimes. It was almost certainly a simple typo, does it really matter who was at fault? I suspect trying to sue a solicitor for negligence will be more hassle than it is worth.

    Does it matter that £600k went astray? Er, yes, a lot.
