Good - so it's definitely either your seller's solicitor's fault, or your solicitor's fault if they're being economic with the truth.mackolicious12 said:Thanks for your responses. Make sure you get receipts for any hotel/storage bills you incur as you'll be able to claim from the party at fault once it's all sorted. As others have said, solicitors will have professional insurance for exactly this sort of thing so you'll definitely get back any financial losses - may just take a little while. (Can be more of a problem if it's another party in the chain at fault rather than a solicitor, as you're limited in what you can claim back by how much they actually have!)1 -
Hi all,
The latest update is that the money is in a transition back to my solicitor's bank account however they are still unable to locate the money specifically. They are not replying to emails and these discussions are over the phone so I'm having to annotate our conversation to them over email so that I have a record. I'm not sure what other options I have so I have used my home insurance to claim for legal support and have started looking for a more permanent place to live. I still have all my receipts and invoices of all the costs I've incurred so far including storage, clothes, and food.

I was just summarising the facts of the situation. Of course the OP will be stressed but they should also understand that because their solicitor or the sellers solicitor has made the mistake they are fully protected from any financial loss. Imagine if the OP had tried to save a bit of money by not using a solicitor for the conveyance!Hannimal said:

I would be on the phone every hour to the solicitor for updates. In fact, I'd probably be sitting in their office as a reminder for them to get their mistake sorted out asap.

I know someone who had to move out of their new home after 18 months - yes 18 MONTHS! - because there was a problem with the title that their solicitor missed, which meant they could not become the legal owners. Imagine having to sort out that mess!
Things can go wrong, which is why solicitors, with their professional indemnity insurance, are worth every penny unlike EA fees which offer zero security about anything really.0 -
That sounds very encouraging, but why the need for a more permanent place to live? Presumably the house you were purchasing is still sitting empty and is only waiting for the money to be transferred before you can take ownership?mackolicious12 said:Hi all,

This sounds like a monumental !!!!!! up.. I would be not looking for anything more permanent and would be on the phone twice a day informing them that the bills are racking up and the longer they take the higher the bills they will have to cover0

I've already begun a claim to get some legal support but I wanted to whether I should start the process of negligence with my solicitor (e.g. asking for evidence as to where fault lies) or should I wait until we've fully moved in and completed 100%?25 -

I would move in, sort yourselves out and give your self time to think.
It removes the emotion, you will have a space to work from and will present a far more factual claim7
