Has anyone heard whether the appeal is going ahead in the case of the wounded veteran Tyler Christopher who lost both of his legs in Afghanistan?

He was sleeping in his car when he was ticketed by a representative of VCS. His prosthetic legs and wheelchair were both visible. His disabled badge was in the process of being renewed.

This claim progressed through the courts and I can only assume that it was heard on papers otherwise that I cannot understand why this case would be held in favour of the Claimant.

I cannot understand either how the Claimaint did not immediately cancel the claim.

I found this case particularly upsetting and I hope that this very brave man has found a barrister to act for him if he does appeal.

We see more and more cases of selfless people that are being shafted by these aggressive bullies. Lets hope that changes happen sooner rather than later.

We all agree, these wild animals should be shackled.
It is going to stop and claims will be kicked out with thanks to HHJ Jackson

When there is an independent appeals system, SRS will no longer be able to quote the scam system called the IAS.
Couple the above with a new code of practice, the future is bleak for this nasty little set up

It did say in one of the newspaper articles that he was going to appeal.

I was hoping that a silk like Nicolas Bowen QC would take up that appeal on a pro bono basis.

The Claimant may have cancelled the claim after all the bad publicity but as they have said, they are "thick skinned".

  • take what you read with a pinch of salt , this was reported in the sun newspaper
    the wording
"Tyler, 36, said his wheelchair could clearly be seen in the back of his car and his prosthetic legs were in the footwell of his car. Despite this, he was still hauled into court and fined £60.

He appealed the charge at Carmarthen District Court near his home in South Wales, but it was increased to £150, The Sun reports.

    ok from the top
Despite this, he was still hauled into court and fined £60. excellent , county court case = £60
hauled  hes a bloody paraplegic in a wheelchair

He appealed the charge at Carmarthen District Court , which is actually called

Carmarthen County Court and Family Court and does not handle county court cases

I thought that it may have been heard on papers because I cannot see many judges finding in favour of the Claimant.

It would have been initially £60.00 rising to £100.00 and then the add ons by the time it reached the court stage.

  • Hauled into court is a term. It does not mean that someone is literally "hauled" into court.  There is shoddy journalism in these newspapers however it does not get away from the fact that these companies cut no quarter with the most vulnerable.

Hopefully the new single appeal service will cancel any PCN issued in these circumstances upon production of the disabled badge which is how it should be. Disabled people don't misuse their badges.

If anyone on the forum comes across a crowdfunding page to help Tyler with his appeal (if happening) I would be grateful if you would post details please or PM details.

    Thank you.
