Good morning, Robin

its been two weeks waiting for satisfactory replies to the enquires from the sellers solicitor.
According to the EA, the sellers solicitor was unable to download the garage leasehold title from HMLR. He ordered the title by postal delivery. There is a severe delay in the postal service from HMLR and possibly take several weeks for it be delivered.
in light of the situation and to prevent the chain from collapsing, will you be able to accept the replies to the enquires?

I'm willing to offer £1000 extra to your firms quote £1677.80 if you are able to exchange contracts on the sale and purchase by Friday 12 th February 2021.

    I'm sure they'll be happy to accept your £1000 but I don't see how that will speed up the replies from the seller.
    Of course, if there is no mortgage involved, and the enquiries in question are such that you are prepared to Exchange without the replies, then instruct your solicitor to exchange without the replies.

    Yes I’m going to email to my solicitor tomorrow morning.
    There is a mortgage but not on the garage deed in question.
    The sale is ready for exchange and the purchase is waiting on the missing deed.
    I have offered £1000 extra if he can get contracts exchanged by Friday.
  • Well if you a) instruct him to ignore the enquiries and b) pay him £1000, and assuming that's the only outstanding issue, there's no reason not to Exchange by Friday. On the garage.
    Of course that also depends whether the house purchase is a) linked and b) if so, ready to Exchange

    Yes my mortgage offer is only on the house. The garage is at the back of the house on different road. My sale side has been ready for exchange several weeks back and the buyer is getting impatient and threatening to pull out.

    Your solicitor's difficulty may be that even if they prioritise your file, the timing of exchange /completion isn't something they're unilaterally in control of.

    It is totally true that by selling a previously rented property it does not suddenly disappear, but it is equally true that it may not be rented again, the person buying it may simply live in it as their own home for life....... and they may never have rented before or, more importantly, never needed to rent as they have the funds to buy. This reduction in the rental stock will only affect those who (as always) are the most vulnerable and the low paid, those who cannot buy, and probably never will be able too. .


    This entire argument that goes something like.....”the government are treating LLs so badly that many want to sell up and get out of the market, then there will be a shortage of properties to rent”

    my point is the properties are still there. There are less and less people able to raise a deposit and get a mortgage. Unemployment is soon to be at great Depression levels when furlough ends.

    who is going to buy all these BTL properties when more and more LLs want out?
