UKPP - Wembley Stadium Retail Park

Hi,
I received a "parking fine" on the 11 January 2020 in Wembley Stadium Car Park and I have followed the instructions on the newbie post until now.  The case is based on "Exceeding the Maximum Stay Period".  I am now at the "Letter of Claim" stage based on a letter from BWLegal and I would like to make sure I am following the correct steps as it seems this is now likely to go to court (if I understand correctly).

The letter states that I need to pay or respond by 09 Feb 2021 or that they are instructed to issue a claim in County Court "without further notice".  The only correspondence directly with them was my original template letter from the newbie thread.

As per the newbie thread, I plan to:
1. Send the following email to UKPP

UK Parking Patrol Office, 7 Christie Way, Christie Fields, Manchester M21 7QY

Dear Sir or Madam

Subject access request ( Data Protection Act 2018 / General Data Protection Regulations (GDPR) )

[My full name and address]

Registration Number: [My cars reg plate number]

Please supply the data about me that I am entitled to under data protection law  relating to myself.

As a minimum, please could you ensure you include the following items:

- All photos or videos you have taken or me, any vehicle registered in my name or related to any case in my name

- All letters or emails sent and received including any appeal correspondence regarding this matter or any other matter

- All data held, any evidence you may rely on and a full copy of the PCN and / or NTK

- A list of all PCNs outstanding against me and / or my vehicle.  I request this for PCNs, including this one.

If you need any more data from me to confirm my identity please let me know as soon as possible. It may be helpful for you to know that data protection law requires you to respond to a request for data within one calendar month.

If you do not normally deal with these requests, please pass this letter to your Data Protection Officer, or relevant staff member. If you need advice on dealing with this request, the Information Commissioner’s Office can assist you. Its website is ico.org.uk or it can be contacted on 0303 123 1113.

2. I will be sending the below to BWLegal:

I am writing to let you know that I am currently seeking debt advice but I deny any debt regarding this case and state that this case must be put on hold for no less than 30 days under the PAP for debt claims 2017.

Furthermore, I have sent you client, UK Parking Patrol Office Limited a SAR and awaiting the response from them.

Could you please help me to ensure I am taking the correct steps?  Would you need to see any further information to ensure this is indeed a real "Letter of Claim"?  Anything else I should be considering at this stage?

  • Thanks for your reply.  Yes, that's correct.
    There is a lot of information and I just want to make sure I am not missing anything.
    Should I take your response as it looks fine then?  The only things that are not from a template are the bullet points in the first email which I have simply expanded on.
    If so, I will send the email shortly and may request assistance with my defence if / when it gets there if that's alright!

    On second reading, I would take out the bit about offering "extra data to confirm my identity" as they should only require a scan of the PCN and a scan of your V5C.  No driving licence or passport!

    P.S. That does come directly from the link on the newbie thread, so perhaps worth clarifying on that post also?
    The newbie thread also mentions that I should make sure this is a "real" letter of claim.  The letter is titled "Letter of Claim" and provides a date before a County Court claim without further notice, so I guess that is pretty clear, correct?

    A real letter of claim should give 30 days and contain financial forms (or a link to them) although you never fill in the financial forms.
    Noted re the info on NEWBIE
  • It does not mention anything about 30 days on the letter explicitly but the title is "Letter of Claim" and in the first paragraph it states "If payment or a response is not received before 09 February 2021, we are instructed to issue a claim against you in County Court without further notice."

    I assume providing at least 30 days notice with a fixed date is the same thing as stating "30 days".

    Yep, if date of letter is 30 days before 9th February it is a LOC.
  • Got it - email sent.  Appreciate your help - thank you!
  • Further to the above, I also sent an email to the landowner's CEO who forwarded it to the relevant person.  This person then came back with the following reasons for not getting involved:
    1. Your vehicle was proven to have parked in excess of the free parking limit of 90 minutes.
    2. In your correspondence with UK Parking Patrol they provided you with evidence as you requested, together with a detailed explanation on why they were rejecting your appeal and your options at that stage.
    3. Having heard nothing more from you they instigated action to recover the monies owing.
    4. In your email passed to me your issues re signage were already addressed by UK Parking Patrol. The signs are independently audited and comply with current legislation.
    5. I have to inform you that the 90 minute time limit is with the agreement of the retailers.

    My issue was that the signage wasn't clear, I had no idea about this 90 minute limit and this is not a reasonable time limit that one could assume based on visiting multiple retailers within the retail park.

    The correspondence I have had with UK PPO was the generic text followed by their typical responses.

    I was going to respond but held back and thought perhaps its best get to advice on any particular points to mention at this point.
    Any thoughts?
