    It sounds very confusing.
    You have the front garden.
    His front door is through your front  garden.
    His back garden is only accessible through the front garden.
    Maybe a plan of the areas and the relevant part of your deeds.
    Hopefully you can get a copy of his deeds.

    Is it not as follows:
    Neighbour has front garden with front door and rear garden with a rear door from their own flat.
    OP has the same front garden with front door and rear garden with a rear door from their own flat.
    There is also a gate, which goes directly into the OPs garden, the neighbour is using the gate, claiming a ROW and crossing the OP's rear garden to access their own rear garden, and thus rear entrance.
    The ROW could have been put in place for deliveries or something hence the need for notice, as the neighbour doesn't need to go through the OP's garden to access any part of their own areas, they are choosing to.
    I can see why it would be annoying, but I guess it is all in the deeds, or is it?  That's the real question

    I would just fence off a pathway around the edge for neighbour to use without being able to see your garden. Cheaper than going legal.
    Me too, but only after changing that path so it goes around the edge not right thru the middle!!

    So he is  coming up the shared path, not going through his front door but going round into his garden to access a back door?
    Id move the path and fence around it. Would be cheaper  than starting a dispute involving solicitors, say you will be dog sitting and need a secure garden and to safeguard him being bitten. Or borrow some children and say they need a secure garden.
  • What is in the 'box' surrounded by the path? Is that part of the building or part of the garden?

    After 21 years, could neighbour have some form of implied access without any restriction now?

    So it might be reasonable for the neighbour to use his back door if he just wants to go and sit in the garden.  but if he wants to bring his bin round to be emptied, or bring a load of plants into the garden etc you would not want to bring those through the flat so that is when I would be using the route through your garden.
