Hi,
Looking for info or guidance. My other half and I own and live in a two bed maisonette (leasehold) which is up stairs. The people who underneath us have lived downstairs for 21 years (leasehold). We have the front garden and they have the back which they have access to via our garden. Our deeds say they need to give 3 days written notice to access their back garden but the old man says because he has lived there 21 years he doesn’t need to ask for permission and that his deeds say he has full access without permission. We have asked for a copy which he refuses to give but he has said we can see them he has also said that he has written to the landowner who has confirmed this and again he refuses to give a copy of the letter but said we can see it. Where do we stand? His wife doesn’t let him use the front door at times because he is a decorator and so he waltzes through the garden even if we’re using it. Where do we stand?

How on earth can it be that someone has to give 3 days written notice to go into their garden. Imagine wanting to sit in your garden on a sunny day but not being abe to because you havent put in a written request. How strange. Is there no way you could come to some agreement with your neighbours for the sake of harmony? Is it such a major impact to you if they go through your garden, could you not make a walkway through and shield it off somehow so that you can still enjoy your garden whilst at the same time letting him through.29

So he has a right of access to "your" front garden and this is his means of access to one of his doors ? You are upset because he hasn't given you three days notice to use this access ? Am I reading this right 😭1

If I had to give 3 days notice to access my garden, I would be sending an annual letter saying"I wish to access my garden on 1st January, 2nd January, 3rd January........ 31st December."18
