Care Hire Claim help? (Hertz)

hi all
I rented a car with Hertz recently. It was midnight & pitch black.
i checked the car for damages but was hard to see. 

Next morning I checked the car in the light & noticed some damage that wasn’t on the report. We parked the car in a locked area so I didn’t happen overnight

i emailed them with photos immediately, but now they’re claiming this against me. 

Do I have any case here?

If you signed the collection note stating this area wasnt damage and have now returned the car with damage on this area your case will be exceptionally weak. Presumably there is no rust or similar that would clearly show that the damage must have happened some time before?

I think this is one to chalk up to experience and a) ensure you check the car properly before signing and b) if you do find any damage probably keep quiet and hope its not noted on the return form either.

Your ownly grounds now really is damage limitation; you are liable for the damage (inc loss of rental) up to the maximum of your excess. Many times car hire companies are cheeky and simply try to charge you the excess in full but if the excess was high and/or damage very minor it can be worth challenging them.
