  • Yes thats my argument, dcbl are acting as legal representatives for the claimant and debt collectors, same company name and address they just change what they claim to be doing on different letter templates.

    Same company numbers? Company number being the same is what matters .
    As for settlign outside of court - why? Just defend. You're more likely to win in court than lose, on average
  • ok , sat back and so this , no regulars have picked up on the fact that this is Mr Terry SZMIDT the man that was a lone trader and ran capital car park patrol <full stop> 

    he is no longer a bpa member , and his sole trading company is no more , he has joined the big boys now and become a Ltd company , capital car park patrol , founded in 24th august 2020 

    DCBL have been conned by this man , actually DCBL asre to gready and have done no research on there client 
    how can a newly formed company (capital car park patrol LIMITED (24th aug 2020) ask DCBL to chase a claim buy a now defunkt one man sole trader 

    the claim and CCJ are wrong on so many levels , not only should it be removed , but DCBL and capital car park patrol LIMITED should be fined and have relivent licences removed 

    this is the second case I have heard of , the other case is still in letter before claim stage 

    just how many of those default claims have DCBL been involved in

    I have severe ADHD  and asd so struggle with the legal world, I'm good with numbers and pattern's, not communication as such
  • your situation is far more complex than a simple set aside several companies have broken UK laws

    There's no such thing as a "sole trading company"; so Mr Szmidt still has personal and unlimited liability for passing the OP's details to the new company "Capital Car Park Control Ltd".
  • ok , you corrected me on using the term sole trading company  the DVLA provided info to Mr Szmidz as a sole trader , this was assigned to another company who instigated court action

    It was bought as the sole trader gave up any claim to it. It would nto be a legal assignment, however that is outwith the scope of a set aside.
    The details above do not help the OP get a set aside, not at all. 
  • a setaside with consent is the last thing to go for , with consent will include paying the ticket/claim 

    once this is settled several parties will have some answering to do , they have committed serious offences by lying to the courts , or at least on the court paperwork that was filed for the default 

    CCPC LTD had no right to bring this case , it was not there case , and it happened long before LTD was formed , DCBL have been duped , or have knowingly filed fraudulant paperwork 

    yes a setaside needs to be done asap and  after that the above charges should be raised with relivent parties 
  • Ok so thanks for this information, so I've looked up that company and your fully correct so I will fight after set aside, is there any further advice or information I need for the set aside or is what I've put down sufficient
