  • yes short and sweet , you can twist knife later , but you must include a "by xx/xx/2021 "

I would not include "without prejudice" in that letter.

Personally. I would make life as difficult as possible for them.  Go for the jugular.

yes agreed no without prejudice , as you are not "bartering" for damages (yet!!!!!) , and a normal letter can be shown to the judge showing terry towel and DCBL as they truly are

    Without prejudice
With that as a header ....
this will pass before the courts for a judge to see
..... that's going to give you some difficulty!

Best check out what you're putting when using such legal phrases.

    "Without prejudice

I am writing in response to your recent letter dated 10/02/21 discussing the fact that DCBL presented me with a letter that contained an 'error of fact' and notwithstanding the client is now prepared to agree set aside judgment without payment.

This case as it stands is that due to the conduct of DCBL and its client I am down have already expended [or spent] £255 for the initial set aside. My credit rating has suffered costing more money.

Unless I am reimbursed the £255 and set aside granted then this will pass before the courts for a judge to see and if the hearing proceeds and you will incur my attendance and other costs too"

As advised by others, I would remove "without prejudice" but I would also add, as @nosferatu1001 says that you want the underlying case discontinued.  I would also modify this.  I would also sort this out maybe add will.

so my English written skills are about that of a 10 year old, i have mentioned this before, this is not where i excel hence why I'm on here.
i don't have a bloody clue about most of this henz why I'm asking for help here.
me posting here IS me checking if what I've written is correct.
    so to clarify
    DO not put without prejudice.
but the rest makes sense ?
  • "DO not put without prejudice. "

without prejudice.  means that you cannot show it to the judge , see the letter they sent you , offering to pay the setaside , they dont want you showing that to a judge

I am sure a regular on here will compose a nice letter

PS , there letter , is it saying DCBL will pay the £100 or there client will pay the setaside , IE whos accepting the blame
