Parking logistics court threat

Hi nov 2018 I parked in Birmingham ‘parking logistics’ car park as I was going to an NHS conference.  I went to get a ticket but machine was out of order so I paid using the app. I realised about an hour later that I had accidentally used my normal cars registration number but I was actually in a hire car. I tried to contact customer service via the website but was only able to send an email- which I did explaining my error and providing the correct registration  (with explanation). 
When I got back to my car I had a ticket. I appealed with all the evidence of paying for parking/contacting the company to  inform of correct registration/told them ticket machine out of use etc and got a generic reply back saying was my responsibility to display ticket - I reiterated the machine was out of order so therefore that was not possible- but reminded them I had paid for a parking spot - just that I had initially entered the incorrect registration (that I had since corrected via the only means of contact- email)
two years later - nov 2020 I received  a £260 fine, court summons and CCJ threat. I appealed (once again providing all the previous evidence) and having numerous calls/communication  with their legal reps (dcb legal) whilst  trying to cope with working as a nurse in the nhs at this difficult time (and losing sleep
over this stressful/unfair situation!)
I have spoken once more today to dcb legal - as they were going back to their clients to remind them there is no loss to them (I paid for the parking that I used) but ‘parking logistics’ still insist on pursuing  their claim. I am at my wits end as it’s so wrong and very stressful. They have offered me an ‘unprejudiced settlement fee‘ of £183 - if I pay now. If not the expense may grow.

    It is not a fine.
    You have not received a summons. It is not a criminal case.
    Please tell us exactly what you have received. (LBC/LoC etcetera.)
    Read the guide to court in the second post of the NEWBIES. This has a step by step guide written by a regular called bargepole that takes you from the from LBC to the court hearing.

    There is a also a sticky thread with a ready written defence that just requires you to amend two paragraphs.

    If you lost, it would cost about £175 to £200. If you won you could get up to £95. IN reality there is no point in paying.
    This site has a very high win rate in court as long as the people who come here follow the advice.

    There is no risk of a CCJ or bailiffs if you follow the guide precisely, even if you lose.

    as above complain to who held the NHS conference. ...  not the reception ... or customer services ... to the manager /manageress. If its a national chain then try the CEO
    how long did the threat o gram give you to pay ? 14 days ... 30 days ....

    Firstly thank you for being a nurse especially in these troubled times.

    YOU ARE BEING SCAMMED BY DCBL.  How much was the actual parking ticket for ?
    Of late, DCBL have been living in the clouds with fake add-ons.  Only this week DCBL were spanked by judge for their rubbish and will get spanked by the courts many many times until they wake up and smell the coffee

    Of course the parking company still want to persue the claim, covid has taken them to point of going bust ?

    Is it possible to show us the court claim please, a jpeg is fine

    Right now you STOP contacting DCBL or the PPC as only Doctor Dolittle can talk to animals

    As you have a court claim, seriously nothing to worry about, you need a witness statement
    Have you yet responded to the claim, when is it dated ?

    So our job  now is to help you get DCBL the next court spanking

    Please stop worrying and certainly stop phoning up horrific DCBL and thinking they are doing anything for you.  

    If you get a claim we'll help you defend it.  Is it the same place as this faulty machine?

    There are four recent claims all relating to the same operator, faulty machines and poorly maintained car parks. 

    Could they do a WS for each other?

  • Hello everyone. I too received a PCN from premier parking logistics back in January 2020 when I'd paid the full amount to park all day. They claim I parked in a space that wasn't allowed. I've now received a notice of proposed allocation to the small claims track. I've requested SAR, also an FOI on how many claims he's submitted (proof of vexatious litigataton) and I've written to my MP. Does WS mean written statement? I'd be willing if anyone else is? 
    I think I made an error in writing my defense before coming to this forum. It's pretty frightening receiving all these legal letters.

    Best thing to do is to read the NEWBIE sticky and all will become clear, especially that WS = Witness Statement.  If you've been allocated to small claims track, can we assume you have submitted a defence?  When you start your new thread, please post your defence in it, that way we can advise what to put in your witness statement.
