    The internet has ears; I just received this from the other developer;

    Thank you for your email.

     I can confirm that the boundary position is no longer disputed, however I am sorry I cannot assist you any further.

     As your relationship is with [your developer], you will need to communicate directly with them, they will be able to advise you further.

    Kind regards

    Customer Care

    It helps, in a way, but is not written in the 'legalese' our solicitor said we'd need, or with the confirmation of who has responded and whether they have the authority to confirm there are no further issues. I will update our provider and see what they say...
    You have it in writing, which is a very good start. Yes having it in 'legalese' would be perfect but this is a very good start.
    Sending you a virtual fist bump.
    Nothing is foolproof to a talented fool.
  • "Yes, I know there was a problem here, but it's all been sorted, we're moving the houses over.  We've changed the plans!"
    Thanks a really good result but to be honest not unexpected as having worked for developers that don't want hassle, they just want to build houses and get them sold and move on.  They tend to take the path of least resistance to limit any cost.

  • OK. Very friendly, lovely Luca at Covea has said we can give our developer until the deadline (next Thursday) and if no joy, formalise legal action for misrepresentation of sale. He checked the policy and we should be limited to £0 (subject to excess).
    Eek. I hate this. Why can't big corporates just do the decent thing and treat customers well, if/when they make mistakes?!

    I doubt you’ll get anything from them. The matter is closed in their eyes why would they spend any more money on it.

    Have the other developers changed anything with their planning applications?

    Maybe they are going with woops we just built them in the wrong place.
  • Not sure... My husband spoke again with our developer on Friday, expressing our frustration at platitudes. They are going to get back to us by Wednesday (they say!) 😂
