Hi
I'm new to the forum but wonder if anyone can help
Dad passed away just before Christmas and I'm helping my 82 year old mum, who is sole exec, to sort things out as she isn't able to speak to people, can't use a computer and really just doesn't understand
I've spoken to the Probate Service and they say probate not required
Dad left a will leaving everything to mum so here is what we've done so far.
Used the Tell Us Once Service for all Gov Depts, returned passport, driving license etc . Started getting replies now so I'm happy I've done this correctly
Bank account - current account was held in joint names so we've taken Dad off and its now solely in mums name. All savings are in mums name only
Credit cards - cancelled all credit cards, there is one with a balance (see question below)
All utilities etc put into mums name
Land Registry - Property held as Joint Tennants so automatically goes to mum DJP form sent to them.
Life Insurance Policy = Mums policy on Dads life so will be paid directly to her
Now the bits I'm not sure about
Car - mum doesn't drive so told me to register in my name and to keep it at her house for when she needs to go anywhere which I've done. Is this correct?
Credit Card Debt of £3.5K - they've written to me asking if there is enough money in the estate to pay this debt. I haven't answered yet as I'm really not sure there is??
Don't get me wrong - there is money but it's all held in mum's name
From what I've read the house doesn't count as part of the estate, the joint account isn't either (so I understand)
So, have I told everyone I need to, have I done anything wrong with the car and what are peoples thoughts about the Credit Card.
I don't want to do anything wrong
Thanks

For peace of mind for your mum (personal point of view not a legal one) I would pay the credit card bill. Do you really want a credit card company chasing debts in your dad's name and risk upsetting your mum?1

How much is the car worth? Were there any savings solely in your dad's name? You need to be careful to assess the value of the estate fairly. You might get an idea of the value of the car from WeBuyAnyCar.com.The comments I post are my personal opinion. While I try to check everything is correct before posting, I can and do make mistakes, so always try to check official information sources before relying on my posts.1

Have you reclaimed any out standing tax on the car and retained it in your name?0
-
The insurance company value to car at 4200.
I was planning to pay the card myself but just checking out what is the legal situation.0 -
Make sure you mother has a WILL.It might be cheaper to sell the car, and get mother to use a taxi for the odd times she wants to go out.Breast Cancer Now 100 miles October 2022 100 / 100miles

Thanks everyone.
The credit card will be paid in full anyway by me as I'm benefitting from the car. Worth keeping as my lease car runs out in 15 months.
All taxed and insured now in my name. Dvla already paid the tax refund to mum, 👍
So looks like I've done everything else correctly? Q

https://forums.moneysavingexpert.com/discussion/6235088/catalogue-debt-after-death#latest
Although the joint account falls into the control of the survivor and the credit card account is in the sole name of the deceased, it seems to me that the C/C company could take steps to recover the debt, (see above and link) especially as there is no doubt that cash is available to cover it.
If I were the widow /widower in these circumstances, I would repay the debt and close the C/C account asap.
With regard to the probate question, is it likely that you will be your mother's exor one day?

Hi.
Thanks, the cc will be paid in full.
I am the exor on mum's will. The total estate is less than 29ok now and with equity release on the house it will only go down so no It anticipated.1
