Samsung Tablet

I bought a Tablet on 4th January from John Lewis. I wanted to be able to use 2 USB C's at the one time as the Tablet does not have an Earphone Socket.I tried using an adapter which had an extra USB C but it did not work. JohnLlewis will not refund because I had used and uploaded the Tablet. Is there anything I can do?

  • I was considering getting a Samsung Tab S6 until I discovered they had decided to do away with the headphone socket. 
    I know that wireless headphones and earphones are available but I have some nice Bose noise cancelling headphones that I use so don't want to have to buy something different.
    As far as I'm concerned, doing away with the 3.5mm socket is a backwards step.

    If you purchased online, then theoretically you'd have a minimum of 14 days to cancel starting the day after you received it. However, if the retailer complied with their obligations on pre-contract information, your handling goes beyond what is necessary to establish the functioning and characteristics of the goods (think what you might be allowed to do in a shop) and that handling dminishes the value, they can make a deduction - up to the whole contract price - to account for that handling. If it fails on any step (ie they didn't give the necessary info, including that excessive handling would result in a deduction, or if the handling didn't actually diminish the value) then they can't make any deduction. 

    If you purchased in store, there is no automatic right to cancel and it would depend on whether their own returns policy allowed it. 

    Both of these are assuming that the goods conform to contract/they weren't advertised as working with usb headphones. 

    Buying appropriate headphones would seem the most cost effective solution.

    I bought online received 8th Jan. Reported on 20th. They say as I "used it " and "uploaded" they will not refund. Should I keep trying?

    Did you specifically state before purchase that it had to have two USB-C sockets?  If you didn't, then I wouldn't bother to keep trying and as advised by others, invest the time and money in finding some headphones that work with it.

    Well, their online terms state:
    • We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you. We will make the reimbursement no later than 14 days after the day we receive back from you any goods supplied.

    So the question is, did they provide that information to you on a durable medium? This could have been by email or in paper form when you received the goods. Websites are not a durable medium, so having it in their online T&C's doesn't meet the requirement. JL are usually compliant when it comes to consumer rights though, so I maybe wouldn't get your hopes up just yet. 

    There is also the possibility they're misinterpreting a section of the legislation. Where the contract is for the supply of sealed computer software (or audio/video recordings) and you unseal it after delivery, you lose the right to cancel. Now, some retailers think that any item containing software would come under this exemption. But they're wrong. It only applies where the contract is for the supply of sealed software. So software isn't sealed or the contract is for the supply of hardware (even if that hardware has pre-installed software)? The exemption doesn't apply and you still have the right to cancel.

    Problem with usb c is there is no universal form with it each company does there own take on it you want a usb c that connects to phone then splits into 2 more usb c so charger in one headphones on the other so charge and listen to music at same time could look up anker there pretty good with making mobile stuff
  • I have a [non apple] USB-C hub for my work iPad Pro that has power pass through, an additional USB-C port, 3.5mm and HDMI. You could search for hubs to see if there is one that will work with your tablet. I second the comment about Anker - very good brand.
  • If you just assumed the adaptor would work without checking, that's on you - if you've used and set up the tablet they can deduct from your refund to account for this.

    In what context are they using the word "uploaded" and what are they saying you uploaded? I can't see what they are on about that you uploaded that could be used to deny you a refund.
