We both had to sign the document which is why I said we. HMRC have agreed that he is eligible to give me some of his personal allowance and that I am eligible to have it. They have changed my tax code and sent me a letter to say a refund of £248 is due. Apologies for using incorrect wording ie approve. I thought this was a forum for people to discuss topics and maybe seek advice or answers, I didn't realise my posts would be picked apart for using incorrect wording!!! Yes, I am aware I signed up to the 3rd party and I am also aware that I should have gone to the Gov.uk site - cheers for reminding me though. The reason I posted in the first place was to see if anyone else had experienced anything like this and also to perhaps warn people to be more careful than I was!Dazed_and_C0nfused said:

It is the person who doesn't apply who gets the refund (if one is due).
Did the Marriage Allowance recipient sign up with this third party as well as the applicant?
He must have applied if you are getting a refund. And therefore you presumably agreed to the third party companies terms.
Most things government related are dealt with through gov.uk nowadays and have been for some time.
HMRC do not "approve" claims, they simply check if you are both eligible and calculate both parties tax accordingly. Most people in the UK are eligible, but not everyone can benefit from Marriage Allwoance

Yes the current year is fine as my tax code has changed but I have received a letter from HMRC stating that a refund is due for 2019/2020 although to be honest I'm surprised as we only got married in Oct last year! The letter does state the the cheque will go to the claims company. As I said in my earlier posts I would be fine with them having it if I felt they had actually done anything but I don't believe they have, apart from register with HMRC that they are acting for me. I did the rest myself through HMRC once I realised I could but because they were registered as acting on my behalf they are getting the cheque, I was advised my HMRC to send a letter asking that this company be removed from my record as they could have a claim on any future refunds I might be entitled to. if you married before 6 April 2020 then there may be a repayment due for the tax year 2019/20 . In that case it will go the claims company.
Current year amendments are done before HMRC calculate previous years.
if there is no repayment due for 2019/20 then the claims company probably wouldn't take any further action as there would be nothing in it for them.0 -

You were due a tax refund for some other unrealated reason. But have signed away your right to receive any tax refund which arises for any reason whatsoever for that particular tax year as you "assigned" any refund to the claims company. As far as I'm aware it isn't possible to change that assignment now unless the claims company also agrees.
The refund is due to Marriage Allowance (which does seem likely, Marriage Allowances saved you £250, less £2 tax you will have owed for that year = £248) and either your spouse or the claims company have applied using the wrong tax year. Once HMRC realise that they will no doubt correct it and you will be asked to pay £250 back.
I doubt there is anything in the contract you signed which says the claims company have to contribute to that. But it would be worth checking however it tends to be one way traffic with these type of companies.

Just a quick one to say thanks for bringing this to my attention. Spoke to HMRC today to discover that marriagetaxclaims.com have put a fraudulent claim in and tried to claim for 2019/20 even though we only got married in Oct 2020. Thankfully HMRC are now dealing directly with this 3rd party to recover the refund they sent them. Also managed to stop them gaining access to any future refunds etc by disassociating them from our accounts!! Phew.....Dazed_and_C0nfused said:

Been mucked about by the TAX office and third party company based in Manchester. I wrongly applied for the allowance via my facebook page and thinking it was a HMRC site filled all the information asked. I received and a pack with several papers where I had to fill in and signed, also my wife.
Didn't think anything would come of it until a week ago when I got a letter fro the HMRC saying Im entitled to £250 refund and the cheque was being sent to a third party accountancy company which I didn't release instructed to act on my behalf to claim all the tax refunds from know on. So I was alarmed when contacting the company via email that they will be sending me the cheque minus there fee, 35% + VAT. In a nut shall I only received £110.04.
I contacted the TAX office to say I wanted this to stop and they said they couldn't do any think as I signed all rights over to that company. I was a bit peeved and then got a TAX demand of £250 which I cant afford to me losing my job to covid and wife on furlough. So a lesson learnt in my books but I do still have the cheque which means I only have to get the rest. Please beware all if it looks a good deal it isn't.0 -
That is the root of your problem. Facebook almost certainly isn't.
One person getting a refund (which the person who doesn't apply usually gets) and a bill (which the person who does apply can sometimes get) is unusual.
