  • This may already be well-known, but interestingly Nexus/CP Plus bang on at some length on their official website about their BPA status, including claiming that they were "instrumental" in developing the Code of Practice!!!

    So I'm really hoping that you're telling me that they've shot themselves in the foot, unequivocally. My husband in getting twitchy and telling me just to pay, but he hasn't read the advice that you guys give out!

  • Also, please do not refer to the speculative invoice as a "fine". It will not be on any of ppc's documents.
  • Hmmm, so potentially a complaint isn't going to have that much impact, then? Certainly it feels like to me that there so many fairly large breaches here (failure to put charge on hold, failure to respond within 14 days and failure to supply a POPLA code) that I'm really hoping a strongly worded complaint will make this stop now. I really don't want to go to small claims if POPLA were to uphold an appeal rejection 😒

    Apologies - but I'm new to all this and don't have the experience you guys have, obviously, or the inside knowledge. Of course I'm going to complain but I was just musing that it sounds like corruption is a problem even inside the BPA...

    I'll complain on day 35 as suggested with all the breaches. Legally I'm not clear on what standing the BPA's Code has as it appears to be a best practice guide rather than a contract - but certainly it doesn't look good for one of its founding members to be behaving like this.

    That's better. I was merely showing you that there is a conflict of interests, but the fact remains, after day 35 if you have no POPLA code they are in breach and also, sending you increased debt demands instead of a POPLA code is a separate breach.

    In your experience have you any thoughts on precedence as to likely responses to this kind of complaint from the BPA? From your previous comment upthread it sounds like things may have changed/slowed down there recently...?

    I think much depends on whether CP Plus show POPLA a rejection letter that they reckon they sent.  If they do, the BPA will believe them unquestioningly.
