I made a formal complaint last week about GroupNexus making a SAR conditional upon being told who the driver was. No reply thus far, even though I know what Steve Clark's view is on PPCs that do that...he shares my view. But like I say, look who pulls the strings.
The silence is deafening but I am hopeful of a reply from the BPA; I usually get one sooner than this though.

Def no POPLA code received. Here's the wording in full from their email response to my online appeal:
Dear Sir/Madam,
Thank you for your correspondence relating to your Parking Charge.
The representations stated in your correspondence have been noted and considered. Please forward to us the full name and address of the driver at the time this charge was incurred so that we can update our records accordingly.
We are placing this Charge on hold for 14 days from the date of this email to allow you to provide the details requested.
Yours faithfully,
CP Plus Limited

Thanks Coupon-mad - I've checked spam folder today and it's not there. They have definitely increased the fine though as I checked online.
I am still assuming that there is no reference to PoFA on the original NTK as there certainly is none on the subsequent two demands for payment. Does this mean my appeal is likely to be upheld at POPLA? Surely the fact they are sending out contradictory information is relevant?0 -
None of it matters because you haven't got a POPLA code so you need to get a complaint in on the BPA portal about this horrible bullyboy firm (who are represented on the BPA Board of course...conflict of interests....).

However, failing to provide a POPLA code is a clear BPA Code breach - no argument - as long as CP Plus don't produce a phantom rejection letter, which I hasten to add, is something only a rogue parking firm would do and no-one would expect from a fine upstanding BPA member.

Thank you. So just sit tight and wait again then? In the hopes they send me a code. If we go to POPLA I understood the fine has to stay at the level it was when I appealed?

Ah apologies I misunderstood what you meant...I thought the failure to supply a code was the breach, not the increase in fine.
I had believed they still have a few days (we're on day 27) to supply me with a rejection letter and a code, whether I decide to respond to their request for driver's details or not (not, thank you).

Send the BPA complaint on day 35.
