With the fabulous help of some MSE peeps here, we have found out very early on that most of the garden of a property we were buying doesn't belong to the vendor (I don't think they realise either). Our solicitor is excellent as well - and remember they don't see the property.

You'd be surprised how often the issue you've had comes up here.We probably get at least a half dozen of the exact same thing every year where the current vendors didn't check the deeds when buying so only some of the property (usually the house) is actually owned by them with the garden extension still belonging to the previous owners.A lot of us on here would even take your suggestion one step further - you can download the title deeds and plan from the LR website for just £6 for any property before deciding whether to view it or not.3

Please read the title deeds and plan before buying a house!I'm just staggered that anyone doesn't.Personally, I always download a copy of both fron the Land Registery before making an offer. If I'm serious enough to offer, I want to know as much about the property as possible before doing so.

first thing I do before viewing .. when I see unregistered my heart sinks as it's going to be a bumpy ride .

We found out the hard way, that what was acceptable 30 years ago is probably no longer going to cut the mustard. Our lease plan just said 'plus garden'. So, to sell, we had to have the plan redrawn by an architect and outlined in red. Then approved by our co-freeholders. Several hundred pounds that our previous solicitors were perfectly happy with.

Perhaps not so easy with a new build. There is/was a post somewhere here where the builders/estate management were trying to claw back someone's land because they (the developers) had ended up building a house with too narrow driveway/access to garage.
