Very worried - Payment Outstanding for a CCJ

Hi All, 

I've received a letter from DCBL stating that I have failed to make payment for £369.95 for an outstanding county court judgement, and that it's been passed to DCBL for debt recovery. I'm pretty confused by the whole thing. I'm pretty worried at this stage. The address (my Mom's address) all previous letters were sent to, I no longer live there. Do I call up and try to make some kind of monthly payment arrangement as I cannot afford to pay that! All of this for parking outside of a dessert shop that I was in :(

    NO!  Don't do that, it's the worst of all options. 

    What is the date of the actual court judgment?  Do you have that court letter in your possession?
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Seems like you know what it is all about then, don't see why you are confused.  Did you ignore the original PCN, the reminders, the debt collection letters, the letter before/of claim and the county court claim form?  If you did not get all that I listed, make sure that your V5C is up-to-date.

    Why why why do people not change the address for their car?  Why why why do people not get their Mums to send on their letters? 

    Sounds like you have a CCJ now, which wrecks your credit rating for SIX YEARS and that's true, even if you pay it off. 

     DO NOT MAKE AN OFFER TO PAY.  THAT MAKES YOUR POSITION WORSE.

    For the love of God change your car's address to stop this ever happening again, and read the SET ASIDE CCJ section of the NEWBIES thread, and don't try to read this forum by phone.

  • I'll be updating the address so that this doesn't happen again. I have the court claim form which is dated 19th November 2020, a few reminder letters and this DCBL letter. Is there anyway to avoid this going on my credit file or is it too late? I picked up the letters last night.

    Make sure the CCBC and the claimant have your correct address for service - you don't want any more letters going astray!

    Erm, you haven't read how to get it set aside yet, have you? If you have a low income/savings this can be free of court fees but otherwise costs £255 for the application, which you will read, can in some case be ordered to be repaid to you by the Claimant if the Judge is not happy with them not bothering to take robust steps to properly locate you. 

    They were not getting replies to their letters and therefore it can be said by you that they had reason to believe you must have moved and could have done a simple trace to stop the damage of a CCJ and deal fairly with a consumer.

     Please read the NEWBIES thread about setting aside a CCJ, which doesn't involve paying the scammer but if the court agrees, does wipe the CCJ and resets the claim to be defended and won by you.

    The next replies we want to see from you are your draft witness statement and draft order  (see the examples in the set aside CCJ section of the NEWBIES thread) and draft defence (the latter based upon the forum template defence from the other sticky thread of that name).

    So by "you have the claim form", why didnt you get this before? DId you not have any arrangements to pick up post?! Insane

    As for this, you will need to do a set aside. Read. Read some more,a nd read again
