Quick update i fired a letter of to BW at the beginning of February giving them till the end of the month for a meaningful response to the concerns raised re the potential illegal access of my details.

Other than an acknowledgement letter and the matter being placed on hold whilst it was investigated I have heard nothing as expected even giving them an extra week due to the pandemic or should that be grace period!!
I anticipated the letter was a vein hope I would disappear but as one famous PM once said “this lady is not for turning “
After defending for the past 3 years now is my time to attack and was thinking of the following course of action.
Firstly I was thinking of complaining to the ICO re breach of DPA/GDPR, If when a response is furnished simultaneously sending  letters of complaint to the IPC and to DVLA informing them of the breach of KADOE regs and send a LBC to the PPC.
    Any thoughts suggestions,thanks

Indeed, IIMU that £500 is the going rate

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Thanks for the responses and I will read up on them over the next day or so.
I appreciate you say the going rate of £500 as this is two separate PCNs where they have passed my details onto four separate companies in the same manner I was thinking more along 4K any thoughts, thanks

That will cost more to file and may be viewed by a judge as excessive.

I tend to suggest £900, which costs a reasonably low £60 to file (£80 hearing fee later as well) and looks less excessive to a Judge when considering it.

£900 sits in the bottom rung of the Vento guidelines which are used to judge remedies for harassment (not just disability cases).  That way you can use the Vento guidelines to explain why you decided on that sum, and Simon Clay v CEL where he only got £200 I think but that was for one PCN with no aggravating features or harassment alleged.

I would not treat what the DVLA say as gospel due to seeing mistakes and false/wrong info given out over last few years
I would be doing a secondary check with the DVLA incase of typo entry or other reason has resulted in a flawed reply
if you start shouting and start doing counter claims , you are not only going to look stupid , but there is a possability of it backfiring and actually costing you a lot of money

ask a profit making goverment department , that answers to nobody

    do you feel lucky ?
