PCN for a company vechicle from UK-CPM

    You do not want to be appealing this PCN on behalf of the leasing company you need a NTH in your name.

    So that I can get an NTH in my name and address would the below be a good first letter to UK-CPM:

    After I get an NTH in my name I can adopt Edna Basher template?

    I challenge this 'PCN' as lessee of the car and subsequently request all future correspondence be sent directly to myself at the address listed below:

    My street
    My Town
    My Postcode
    I am the vehicle's hirer and keeper for the purpose of the corresponding definitions under Schedule 4 of the Protection of Freedoms Act 2012 (POFA) now it is proven that in this instance, the registered keeper is not the "keeper" (as defined under POFA), Civil Enforcement has no reason to contact Grosvenor Contracts Leasing Limited again regarding this PCN

    There will be no admissions as to who was driving and no assumptions can be drawn. You must either provide me with the IAS code in doing so code or cancel the charge.

    I look forward to receiving your response within the relevant timescales specified under the Internation Parking Community's Code of Practice.

    No, that's not right.

    In order for the Registered Keeper, i.e. the hire company, to transfer liability to the day to day keeper, i.e. you, the hire company just needs to follow the instructions on the Notice to Keeper they received.

    It really is simple - usually just a tearoff slip they need to return.

    That's three or four of us who have now said that Grosvenor need to use the tear-off slip to pass liability to you.  You need to go back to them (via your fleet manager maybe) and get them to do their job properly.

    If you can appeal " on behalf of", appeal " on behalf of" naming you as the hirer.

    As above , ideally Grosvenor do it , because until they do , it's their legal liability , same as their electricity bill in their name is not your liability to pay or dispute in your name or their nane , people need to realise that an invoice in their own name is their responsibility. If they want to transfer liability they should follow the law , because the law is the law

    They have been last and tried to pass the buck with no legal advice sought

    If you are appealing on behalf of , then use the fleet manager template by Edna basher , not the hirer template , save that one for later , when it's in Your name

    Five of us now - this is what to do. 

    Grosvenor don't want to be liable do they?  Stupid idea, what they have done is remained liable in law! 

    So they transfer liability by giving your correctly spelt name and POSTAL address as hirer and have done with it.   Then  - once you get your own NTH - it is all yours to play with, by appealing as the hirer.

    I thank you all for your responses and your patients. The answers to my questions may seem obvious to you in the know and you probably get annoyed with me. However, English is not my first language and it takes me quite a lot of time and effort to go through all the posts, translate and understand the legal jargon.

    You are doing a good job so far , it's not easy to get your head around , but if somebody else fails to do their job properly by following English laws , then ideally you inform them to do it properly first , then we can tell you how to do your job properly later on

    You would not pay their gas bill or their car service bill , if it has their name on the bill , they are responsible for that bill until they legally pass on the responsibility , by following an 8 year old law to name you as hirer by using the tear off slip on the invoice , not a difficult task

    Make that six. Do the job correctly, otherwise it could end in a real dog's breakfast for both you and the lease company to have to unravel.
