Been on with Stepchange for years, cancelled them to self manage my debt. I requested the CCA they have sent a photocopy of it. They have sent me a letter saying i need to call them or they will look to give a CCJ. I owe £1200 to them and offered £300 full settlement. I haven't paid them for 3 months. 
I have a default from 5 1/2 years ago waiting to drop off my file. I don't want a CCJ as i am trying to get straight. Any ideas or should i set up a payment plan? will they get a CCJ or is this just a threat? in the ideal world i want a low settlement

  • If you're genuinely trying to "get straight" then the way to do that is to pay your debts off.  So I'd advise doing that.
  • If you can reasonably afford to clear your debts within three years, do exactly that.

    If you can't reasonably afford to clear your debts within three years, but have assets exceeding £1,000 in value, sell them, and use the proceeds to clear your debts.

    If you can't reasonably afford to clear your debts within three years, and don't have assets exceeding £1,000 in value, apply for a DRO if your total debt is under £20,000 or apply for Bankruptcy if your total debt is over £20,000.

    Simple.

    You were paying the debt up until three months ago, so whilst the default will fall off in about 6 months, you will still be liable for the debt - so Cabot could look into getting a CCJ anytime in the next 5y9m.

    I guess you requested the CCA in the hope they wouldn't get it and the debt be unenforceable. Well they have it, so they will consider it for a CCJ if you continue to not pay it. On what grounds are you wanting a partial settlement - if it's just to get it cleared I doubt, now they have proof of debt in terms of the CCA, will settle for anything less than the full balance.

    If you have £1000 available to spend on shares then you're probably better off to clear your debt first and avoid getting a CCJ which will impact long into the future.
