Thai Airways Refund

I booked a flight to Bangkok, Thailand in January 2020 and due to the ongoing Coronavirus pandemic situation I contacted the airline Thai Airways and they informed they would refund me within 6 months. It’s going to be the full 6 months next month (Feb 2021) and I contacted them further this month to find out how things are coming along as I thought I would of been refunded by now. However they emailed me this morning saying this - 

Thank you for your email. Your refund is in process but unfortunately we are still unable to give you timeframe when you receive it. Below is the latest information we can offer you. We are hoping for more detailed information soon.

 

As you may be aware that Thai Airways International Public Company Limited ("Thai Airways") has encountered financial difficulties and on 26 May 2020, Thai Airways filed a petition for a business reorganization at the Central Bankruptcy Court of Thailand (the "Thai Bankruptcy Court").  On 14 September 2020, the Thai Bankruptcy Court has granted Thai Airways' business reorganization order and appointment of planners. Next, the planners of Thai Airways shall furnish the business reorganization plan to the official receiver and the official receiver will then call a creditors’ meeting to consider the business reorganization plan. Subsequently, the Thai Bankruptcy Court will consider and issue an order approving the business reorganization plan and appoint the plan administrator. Thai Airways could then promptly proceed to implement the business reorganization plan. In addition, please also be advised that on 18 November 2020, the Court of England and Wales made an order at approving recognition of the Thai reorganization proceedings as foreign main proceedings under the Cross Border Insolvency Regulations. As a result, there is an automatic stay against: (i) the commencement or continuation of individual actions or individual proceedings in Great Britain concerning Thai Airways' assets, rights, obligations or liabilities; (ii) execution against Thai Airways' assets in Great Britain; and (iii) right to transfer, encumber or otherwise dispose of any assets of the debtor is also suspended.

 

Despite various difficulties and limitations, Thai Airways affirms to you that our policy has been and will always be to facilitate and accommodate all passengers and refund customers to the best of our ability. Thai Airways is using our best efforts to take care of and prioritize our customers and process the refund as soon as practicable.

 

We sincerely apologize for any delay or inconvenience caused to our creditors, business partners, customers and any other interested parties. In any event, we strongly believe that the issues relating to the reimbursement of the price for unused flight tickets are matters to be properly dealt with in Thai Airways' business reorganization proceeding of the Thai Bankruptcy Court to ensure fairness to all creditors of Thai Airways.

I paid using PayPal Credit but have paid off PayPal Credit in full already. What can I do other than just waiting for the full refund to hit my account? Is there anything PayPal can do?

    If you paid by PayPal credit, then that should be covered under Section 75 of the Consumer Credit Act, as PayPal were a credit provider.

    Get in touch with PayPal and tell them you wish to claim under Section 75 for the transaction. No idea how good PayPal are at section 75, you may find at first customer care aren’t experienced with it, or may confuse it with PayPal Buyer Protection and tell you you’re out of time. But that’s incorrect.
