    The date on the notice was not the date it arrived through my door.. It got to me weeks after the date noted on the notice and had exceeded my appeals time frame.. 
    You haven't answered my question - was that NTK addressed to YOU and not to the lease firm?

    Have you complained to the BPA about the fact the PPC appear to have not sent it, then sent it weeks later?

    then you cannot use POFA because you blabbed about being the driver, whereas C P PLUS will have failed POFA by not issuing a valid NTH (hirer notice) and also failed to include the hire or lease docs too

    so your winning point as HIRER KEEPER was thrown away by appealing as the driver

  • @Coupon-mad- No, before finding out about this site 2 days ago I was not aware of the agencies for complaints and appeals. I will be contacting the BPA tomorrow! 

    @ Redx - Yes, it would appear that my naivety has let me down here and that would have been my out.

    PLAN A is in motion and I'm hopeful that there will be a ray of light from Moto HQ ... but failing that what would you suggest now Ive gone and made a pigs ear of it up to this point??

    A day in court and work on my mitigated circumstances mixed with an attack on their signage in the hope a sympathetic Judge sees it for what it is?

    Way too premature. CP Plus (or Nexus Group as they currently call themselves) hardly ever go anywhere near a court. In 2019 (latest figures available) despite issuing 182,450 tickets, they made only 4 appearances in the Small Claims Court as a company - so these may have had nothing to do with parking per se. 

    Even if they did issue proceedings against you today, it will be Christmas before any likelihood of a court hearing. Lots of water to go under lots of bridges before then. 

    So for now, follow the advice above (about Plan A) and the NEWBIES FAQ sticky to take you further through the process. 
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    A result.. After writing to Moto and also to CP Plus, they have instructed the debt agency to close the case.
    Even got an apology, lol.

    Ps , when you replied asking for suggestions , there were none , other than plan A , the alternative being fight it in court

    You learned a valuable lesson there , if you don't ask , you don't get

    That's great news!    So glad it was sorted.

    No idea why MOTO use CP Plus and let this happen to people though.  Cancelling one because they can see you are on MSE (and I bet they did see) doesn't make their modus operandi right.
