It is non-PoFA compliant but VCS are a nasty, nasty company and don't care about anything other than scamming money out of people.
They should be ashamed of themselves, but just aren't.
You will still need to go through the process of the initial appeal then waiting for the court claim later on. If the keeper wasn't the driver, then say so and add a one liner to that effect in the template appeal in blue text you will have found in the first post of the NEWBIES, but without revealing the driver's identity of course. Also add a line that the NTK is non-PoFA compliant.
This won't help now, but will help when this gets to court.
When it is rejected, complain to the IPC that the keeper is not liable but they are still being pursued by the scammers. Again, this won't help now but it will help when this gets to court because it will highlight how the unregulated scammers and the ATAs funded by the scammers are biased and not fit for purpose.
What happened when the keeper complained to the landowner?
You need to get pics of the site and signage (covid restrictions permitting) as soon as possible.
Also complain to your MP about this unregulated scam.
Obtain/keep proof that the keeper was elsewhere and could not have been driving. Mobile 'phone location tracking is useful for this if it is enabled, as well as receipts, work logs, witness statements, appointment cards etcetera.

Does anyone have a link to an appeal template and how soon is this likely to be cancelled i.e. will it be straight after sending the first appeal.Oh were it so simple. Appeal template in the NEWBIES FAQ sticky, first post, but that won't get you a cancellation, it simply indicates that you have entered a process by which to try to resolve the issue, and which you can show to a court in due course.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

This is an example of Simon Renshaw-Smith's finest efforts at rogue ticketing, when he (Captain Clampit) was stopped from illegal clamping. Come on, there is no appeal to VCS that can possibly 'work' and no appeal to the IAS because it is a kangaroo court.
Give IAS a go though because someone did manage to win last week...about the POFA, by sending an hilarious IAS appeal about it being as useful as 'tits on a fish'. Copy that style, let's have some fun this year with the IAS before it gets replaced with a proper appeals service.
If the IAS refuse (only 5% are upheld) then people win these at court.
No-one pays the likes of VCS unless they need their bumps felt, because that is supporting the scam and funding the next PCNs. If the British public were more robust and could sniff a scam properly, these firms would not have survived the clamping ban in 2012. Instead they have flourished, thanks to:
(a) idiot victims paying either because they have more money than sense or are scared of winning in court and instead pay for an 'easy life' (and fund the scam);
(b) the BPA being believed by the Dept for Transport in 2012 who took their 'advice' as an expert regulator view instead of the Trojan Horse it was;
(c) the Supreme Court having a brain fart in 2015 and twisting the extortionate parking charge in the Beavis case to 'fit' with the Makdessi case. The Judges showed they had absolutely no clue about the rogue industry they were propping up and very little regard was paid to fairness and consumer rights, etc. The Supreme Court has most to answer for: they actively caused the 110,000 court claims per annum that this horrific, bullying ex-clamper thug sector currently engineers to claim stage and Neuberger and co can count themselves responsible for the pre-action letters all quoting the stupid Supreme Court decision and scaring people into paying more than a court would ever allow.
That's justice, apparently.

I received a penalty notice for £100 from Bristol Airport parking(VSC) last October for stopping on a red line (no stopping lane) on the way out of the airport, to allow my wife , who was in a great deal of pain (her Knee) after collecting her from a flight. Due to Covid everywhere was quiet so no other cars around, so I pulled in for a minute so she could adjust her seat to get comfortable. I was concerned that there may not be anywhere else to pull in on the main road for some time.
I appealed via the IAS ( Independent appeals service ) as listed on their letter, explaining the situation and also that the time on the photo was wrong as the plane would not have even landed at that pont! I then received an email saying the appeal was rejected.
I have now received a letter demanding £160 and threatening legal action. We are both in our 70s and have enough to worry about.
Its very frustrating as we cannot contact the firm by telephone or email as its only a 'no reply address' Any suggestions please?
