Currys Business sent me a faulty used item and are not responding to my emails regarding a return.

I bought a USB mouse from Currys Business at the beginning of December, I finally received it last week.  It cost £8, the item they sent me does not work properly, left mouse button does not click or respond.  The box was quite damaged, to me, the item is not new, most likely a faulty return which they just sent out to me as a new item.  I have emailed them several times regarding a return but so far they have not responded.

I have recently read quite a lot of reviews of this company and it does not look good.  They seem to be a really shoddy outfit.  Would I be in my rights to file a chargeback with my bank?

    Business to business as opposed to Consumer .
    Have you not phoned them .
    Or tried Currys Business manager / Twitter/ Facebook .

    I am a regular consumer as opposed to a business, I have no idea if that makes a difference.
    So why are you buying from their business division? I doubt you can do so and then claim you're actually a consumer with consumer rights.
    The very first clause of their terms is pretty clear:
    "Currys PC World Business (CPCWB) is a business to business reseller. In buying from CPCWB you agree that you are buying goods or services only for business purposes. The liability provisions in conditions 28-32 below set out our responsibilities to you in more detail, but as a business customer, purchases you make from us will not benefit from the statutory protection available to consumers under the Sale of Goods Act 1979 (as amended) and related legislation."
  • It still needs to work and not be faulty - being a business contract doesn't mean you have no rights - just that you don't have consumer rights.  Get back to them and complain.

    you can try a chargeback but does that apply to business contracts which your bank may say this is?  Certainly Currys will challenge it with your bank as business if they can.
