Telephone hearing in June.. help and advice welcome

  • Thanks all for the help. I just emailed the pdf defence to CCBCAQ@Justice.gov.uk, received the receipt and then realised that I had stupidly signed and dated it for 15.1.20... should I correct it and submit it again?

    No harm in sending it, just state you made a mistake on the date. 
    Doubtful anyone will give two hoots regardless. Obvious errors can be corrected.
  • So, after a few months of no activity in regards to the court claim, I've had my notice of allocation to small claims track. My hearing (by telephone) is on the 16th of June. I'm presently working on my ws and really need a bit of assistance. I've been given two dates to send things by; 7th of May for all documents I will be relying on and 21st of May for the ws. Could anyone help to clarify what documents I might use and need to submit on the 7th? I have been thinking that all my photos and case transcripts would be part of the bundle that gets sent with the ws.....

    Strange that you have been given two dates.  What does the Notice from the court say?
  • The notice says: 
    4. By 7 May 2021 the DEFENDANT must send to the Court and to the CLAIMANT copies of all documents he intends to rely upon at the final hearing. These must be in a bundle with each page clearly numbered. The Defendant MUST bring the originals of those documents to the final hearing.
    5. By 21 May 2021 the CLAIMANT and DEFENDANT must send to the Court and to each other, copies of their own witness statements and those witness statements of all the witness they intend to rely upon at the final hearing. 

    I've had an email off the claimant already, it's the particulars of claim.

    That is duplication of effort (in my opinion) but you should do what the letter tells you.
  • That's what I thought too! I have to admit that I'm a bit confused... the only documents I can think of that I'm relying on are the pictures and case transcripts that I was going to include with my ws bundle. Should I send all of it in on the 7th? Or is there something else I need to do seperately? Have I missed a step?

    Wonder why the court wants you to have to show the C your evidence first.  Some courts are so pro-Claimant they are practically licking their feet.

  • It does seem worryingly so.... at the least, they seem to make it as confusing for the layman as possible.

    I've just noticed that the C has to send me a copy of all their documents and particulars of the claim by the 30th. I've not received their documents yet, only the particulars of the claim; which included generic graphics of parking signs. Are the graphics their documents?!? 

    Suppose I'll just wait and see if anything comes through from them over the next few days and then follow their example. Could I send just my photos in as my documents or would I need to include the transcripts too? I don't feel comfortable sending my ws in ahead of the C.
