Item didn’t arrive next day m

Hi all,
I need help if possible, I bought a microwave and paid extra for next day as my one broke and I’m disabled so relay on microwave quite a bit to cook my food. However the item did not arrive at all the next day I was in urgent need to I ended up getting a different microwave I went to cancel the one I originally sent but then I had an email said it had been dispatched I then ended up with 2 microwaves. I have requested for the one I originally bought to be sent back to then be told I would need to pay for courier to come and pick it up.

What are my rights on this please will I have to pay? As I haven’t an apology as yet about the item not arriving next day I can’t afford to be further out of pocket as it wasn’t my fault. Please help. Thanks

  • When did you buy and then expect delivery, when did the microwave actually arrive?

It depends whether it said ‘order today with Next day and get it tomorrow’ or simply a next day delivery service, which simply means it will arrive the day after it is posted as opposed to 3-5 days or whatever

What day and what time did you order? Which company is this?

Did the online receipt specifically say it would be delivered that particular day? e.g. if you ordered it Wednesday 30th, did it definitely say it would be delivered Thursday 31st?

Why did you not reject the delivery?

You say you WENT to cancel it. Did you actually then cancel in writing?
Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')

No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

I can't think you'd have any rights at all in this situation.  The only grounds you have for returning the microwave from the distance seller are a change of mind.  Essentially there's nothing wrong with it, but you don't want it anymore.  That's not the seller's fault and it can't be expected to cover return postage.  The fact that you bought a microwave somewhere else, a real-world shop presumably, is immaterial.
There may not, in addition, have been any sort of failing on the distance seller's part.  It might well have a daily despatch cut-off, after which orders received are processed the following working day.  If that was the case, then despatch happened on day one and the item was received on day two, all within 24 working hours.
I'm afraid that this is your fault, to a certain extent.  You jumped the gun with regards to the first microwave.  Surely it would have been easier just to eat something else or get a takeaway in preference to going out and buying another microwave?

OnBuy.com are not a retailer, they are a marketplace.

That is pretty good delivery at that time of year.

You went online to cancel the next day to find an email saying dispatched?

But good that you were very quick to get another one that same day.

It must get used a lot so put it away and keep for when your new one breaks down?

  • I would keep both - when the one you are using now breaks down you will not need to order or wait for a new one.
