I have read all newbies thread and thank you for the information.I have received a telephone hearing date and putting together my reply.I am an essential worker and although could possibly attend It may be difficult due to work commitments. Would this go against me or give the claimant the upper hand?
Will they postpone or go ahead in my absence. Furthermore, I was concerned about the threat of paying for an adjournment. This is not stated in my letter.Thank you for your advice.0 -

Their documents are written by lawyers who do this for a living, and on paper are always likely to put forward a stronger case. You won't be there to challenge anything they say, and they are very likely have a lawyer representing them at the hearing.Have you been asked to provide dates when you are not available for the hearing? There is no easy way out of constantly not being available. An adjournment wouldn't change that position either.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Thank you all for the insight and advice given to continue my defence again Civil Enforcement Ltd parking fine.I had a court hearing date set and as per your advice gave my telephone to attend hearing. Approx 2 weeks prior to the hearing I received a letter from the courts stating that the claimant CE Ltd. had not paid the court fees required therefore their claim was struck off. Phew!! After all that. So I was, to say the least, very relieved. !! Thank you.2

Push the defendant hard to comply with deadlines and procedures, hoping for an error in compliance, then slam in the application for a judgment in default. But, when they realise the defendant has been well advised, has done their homework thoroughly and has jumped every hurdle put in their way - hey presto, like the Will o'the Wisp, gone in a puff.Please note, we are not a legal advice forum.
