    *** UPDATE ***
    Morning all, after following the advice on this forum, the ECP parking ticket above was appealed using the exact words in the blue template.
    ECP came back with an email that documented PDT payments and partial VRN's as requested. Upon looking at the payments made at the machines, they stopped just before 8am, and then resumed at 3pm - in other words, no payments were taken at the machines between 8am and 3pm, despite it being a busy car park in the town centre. This stands up to the driver's account that they attempted to pay, but couldn't due to the machines not working.
    Should this information (ECP's own proof that the machines were not accepting payment) now be going to POPLA?

    You need ot point out, on the balance of probabilities, the machine was broken. Busy town centre yet no parking or noonoe paying for parking at a working machine for 7 hours? Thats highly unlikely.

    Thanks for your help. Will I need to quote POFA when contacting POPLA? I can’t see anywhere that pertains to the malfunction of payment machines preventing the driver from making payment.

    Pofa is about keeper liability , nothing to do with pdt machines

    Check the BPA CoP Jan 2020 edition and the CRA 2015 , plus frustration of contract
