Bankrupt settled debt still on file

Hi, I was discharged in 2016 but the company refused to mark the debt settled or 0 balance( all other creditors did so in line with the bankruptcy)  and has the full amount plus i'n default' on my score. I have wrote to them, the financial ombudmen and Equifax who state the company has to change this despite providing them with court documents. I have recently contacted the ICO but am not hopefull due to the company stance over the last few years. Who else can I ask to help the company really refuse to update and still send me joint annual  statements. Clearly this is inaccurate information and causing me some angst. Any advice would be welcome I am considering solicitor or MP but would consider anything to get them to leave me alone.

    Did you follow the credit clean up instructions from the BR board?  But, just noticed you said they are sending joint annual statements, what kind of debt is it?  And is it joint?

    Dont worry about your score too much as only you can see it, your history is more important.
  • You've done the right thing writing to the ICO. It's the ICO's guideline's that they're in direct breach of.

    I had this with nPower too but when I raised a formal written complaint quoting the ICO guidelines they changed their stance and sent me £75 to apologise.

    The ICO Guidelines are as follows:

    I was discharged from my bankruptcy last year but the CRAs have not amended the accounts on my credit file to show this. What should I do?

    Once you have been discharged you will have to notify each of the lenders whose accounts were included in this bankruptcy as they will not automatically be told. You should send them the evidence of this and ask them to amend their entry on your credit file to reflect this. The specifics of how it will look vary depending on the CRA but the entries should be marked in such a way that any lender searching your credit file can clearly see that this debt is no longer outstanding and you are not being pursued for it. Most accounts that have been discharged from bankruptcy will show as settled/satisfied or partially settled/satisfied with a zero balance outstanding.

    If any of the lenders respond refusing to amend their entry or fail to amend their entry within one month of receiving your proof of discharge you may wish to make a complaint to the ICO. Please note, in this instance it is the lender who is the subject of any complaint you raise with us, not the CRA.
