Bankrupt Landlord

    I’ll deal with the rent when it comes to it, I’ve dealt with the up keep of the property for 2 and a half years now. Who will reimburse me for the money I have spent doing this?  



    1, I don’t have a clue who it is 


    2,  it will be 3 years in April since I last had any letters from anyone bar a debt collector banging on my door looking for the Landlord. 


    3, Tried to contact my ex landlord he has disappeared of the face of the earth. Found his address on the title deeds I got About a year ago. ( i do pop over now and again just to check) 


    4, I’ve lived in the property for over 10 years now and never dealt with a letting agency just him. So I think I may have lost my £2000 bond. 


    5, the company I was dealing with were no help at all, said they couldn’t help because of new GDPR regs.


    6, I don’t know what bank I need to go to ask. 


    7, My solicitor talked to me about it, but said nothing much he can do until I receive a letter from who ever owns the house. (Talk to him every 6 months roughly) 


    8, already do this, that I found out his name was on the title deeds and an a dress, where he no longer lives. 


    9,  the company that took over his houses did a gas safety check when they took over in March 2018. Since then I’ve done it 2019, 2020 and no doubt next year to. Who would I report to the HSE myself? 


    Where do i go from here? 


    Is there anyone else I can talk to for advice? 

    if you are happy to stay there then just carry on as normal.  set aside the rent until you are asked for the rent.  any maintenance work that you had to pay for because there is no landlord, keep the receipts as you can claim that against the rent.

    you can also claim the deposit against the rent so you won't lose that.

    Have you checked https://www.insolvencydirect.bis.gov.uk/eiir/ to see who his Trustee in Bankruptcy is? Or is that who you meant when you referred to 'the company looking after the property"?
    As you have got copies of the Office Copy Entries do they not tell you (in the 'Charges Register' section which bank has a mortgage over the property? If there is no mortgage, then it may take longer for someone to get around to applying for an order to sell the property to pay off some of the debts.

    You did this through choice. Any money you spent without the landlord's consent, and without having gone throught the Shelter process linked above, was voluntary. You can ask for it back but have no legal claim for re-imbursement

    No clue who who is? The landlord? The bank? The solicitor? The company? Who wrote the letter?

    the timeframe makes no difference. Rent can be demanded for up to 6 years.

    is he still the registered owner then?

    Do you hae a receipt/evidence of payment. Is it protected? Have you checked? If not, deduct from rent. After so long paying rent I suspect youowe morethan £2000!

    what company? You have not really told us who told you exactly what in your letter.

    Nor why you chose todonothing for so long (though I suspect you were happy living rent free and just wanted it to continue...)

    You have the Title Register. Read S3 the 'Charges Register'.

    OK, up to you to choose towait or be pro-active. Why have you decided now to be pro -ctive?

    You couldpay a search agency to track him down.

    You can only report to HSE if there is no GSR. If you report to them they will respond "There is a valid GSR for this property."

    Where do i go from here?

    Well clearly the company that did the GSR has taken some respnsibilty. In 2021, write them advising them the GSR is due in xx/xx/1921 and that if they do not arrange it you will report them to HSE. That will doubtless initiate a response.

    Is there anyone else I can talk to for advice? 

    Local law centre? Shelter? CAB? Another solicitor? A Search agency? The bank? The company?
    You have lots of options- why not follow them all up?

    This tenant won`t be unique in not paying rent for a while.

    Why not just move somewhere where you can get hold of the landlord?

    So what? 
    So sometimes you get away with things like not paying rent, or speeding, but that does not mean you always will. The fact the bank never asked your friend for any money does not mean that the OP can assume rent is not due, and will not be demanded.
