Moving in tier 4

No rules published on this yet, but am concerned for my ability to help my daughter move home on Monday. Since exchange of contracts she has gone from T2 to T4, but we live in the next county and am still in T2.

    House moves were allowed in the last lockdown.  So I would not expect the tier 4 regulations to prevent them.

    I will look for the link to an analysis of the lockdown regulations on moving.

    I am not supposed to travel across the county border, but she has a 2 year old to look after and is 6 months pregnant, which I would hope provides a reasonable exception to to break the rules.

    Rake the time in the day to enjoy it.  You GET to help them move home. 

    Relish every minute and remind them that this is a privilege at a time like this.    Hold it in your heart, forget the stress and just enjoy that you're together helping each other in that moment.  The next time doesn't matter until after.  
    Which actually made me tear up. Been awake since 01.30 so using the time to update lists, label boxes etc AND to whatsapp my son who lives in Hong Kong. Heaven knows when I'll get to see him again.

    Here is a link to the amended Health Protection (Coronavirus, Restrictions) (All Tiers) (England) Regulations 2020 https://www.legislation.gov.uk/uksi/2020/1374 They have been updated with the changes effective from Sunday 20 December 2020 introducing the Tier 4 provisions.  The main change is to add Schedule 3A with the Tier 4 restrictions.

    Leaving home and house moves 

    A key is a general prohibition on leaving home in Tier 4 in Schedule 3A paragraph 1:  "1.—(1) No person who lives in the Tier 4 area may leave or be outside of the place where they are living without reasonable excuse." 

    Paragraph 2 sets out exceptions, where there is a reasonable excuse. These include exception 1(f), where it is reasonably necessary to leave home:

    (f) to undertake any of the following activities in connection with the purchase, sale, letting or rental of a residential property—

    (i) visiting estate or letting agents, developer sales offices or show homes;

    (ii) viewing residential properties to look for a property to buy or to rent;

    (iii) preparing a residential property to move in;

    (iv) moving house;

    (v) visiting a residential property to undertake any activities required for the rental or sale of that property;

     Restrictions on gatherings

    There are restrictions on "gatherings" in Tier 4 areas in paragraphs 3 to 5 of Schedule 3A.  Paragraph 6 gives some exceptions to the general prohibition on gatherings including:

    Exception 3: gatherings necessary for certain purposes

    (4) Exception 3 is that the gathering is reasonably necessary—

    (a) for work purposes or for the provision of voluntary or charitable services;

    ………………………………………..

    (e) for the purposes of a house move.

    Closure of businesses

    Paragraph 10 requires some "restricted businesses" to cease during lockdown.  They are listed in paragraphs 15(2) and (7) and include auction houses.  Estate agents and solicitors are not listed.

    Paragraph 16 deals with other businesses in the Tier 4 area offering goods for sale or for hire in a shop, not listed in paragraph 17.  They should close their premises unless required for providing deliveries or collection pursuant to remote orders. Estate agents are not caught as they are not offering goods for sale.  Nor are solicitors and conveyancers.

    Paragraph 17 sets out businesses permitted to remain open, it includes banks and garden centres.
