I ignored the first few letters now I’ve received a letter from the county court business centre. I have followed the advice in the newbies guide and responded to the claim form stating that I disagree with the fine.
    Hello and welcome.

I am struggling with the bit where you say you "responded to the claim form stating that I disagree with the fine".

How exactly did you respond? Who did you respond to?

Oh... and of course it isn't a fine.
I replied to the courts via the online system money claim.gov.Uk

Are saying that you wrote something in the Defence and Counterclaim box?

I'll say it again... what exactly did you write? And in which boxes?

I’ve not started the defence yet I’ve simply filled in the AOS stating that I aim to defend the case. I then went on to use the general templates for the defence and realised it states not for businesses

    thanks
  • the max chargable for a private parking ticket in the UK is £100 , a company can claim back court fees and charge a max of £50 for legal fees

the figure of £275.03 has been highly inflated
by not replying to the parking co and naming a keeper at time of incident  , you have now got cel chasing a ltd company , and the case will be held at THERE local court , not yours
I have bank statements and hire booking confirmation etc that I can get hold of easy enough. Should I just file my own defence and hope for the best do you think? Worst case I loose and I have to pay the £275.03 or will there be extra charges on top.

    Thanks

Ah... that's the first mention of AoS or Acknowledgment of Service.

What is the Issue Date on your County Court Claim Form?

Upon what date did you file an Acknowledgment of Service?
Your MCOL Claim History will have the definitive answer to that.

    Issue date 30/11/20

    AOS date 13/12/20

With a Claim Issue Date of 30th November, and having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Monday 4th January 2021 to file your Defence.
That's nearly three weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.
Don't miss the deadline for filing a Defence.

Much of the template defence will be OK for a company defence, especially if the car was NOT being used for company business (e,g, if the driver was shopping at a retail park or using their gym).  So what was the situation and location?

If the driver was on company business (such as carrying at work at the location) then the defence will need to be quite different and the Consumer Rights Act won't apply if the driver wasn't acting as a 'consumer' that day.

Also, please check the Notice to Keeper to see if it has the POFA words on it (front and back).
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
