Civil enforcement ltd

Hi

I’ve recently received a few letters from civil
enforcement Ltd regarding a parking offence. I ignored the first few letters now I’ve received a letter from the county court business centre. I have followed the advice in the newbies guide and responded to the claim form stating that I disagree with the fine. I then went to go ahead with the templates for my defence but realised that it states not to be used for a business. The fine is for my company van. Is there another template I can use for this?

The offfence in question is for a 40 minute stay in a hotel car park. There were spaces available so I parked in one went over to the machine to pay and the machine said there was no spaces available. I went up to the hotel to ask them and it appears that parking spaces were pre booked. I took my bags to the room and went back down to move the van.

The fine is for £20.03
plus £25 court feee
legal costs £75

Any help would be appreciated

thanks

    Hello and welcome.

I am struggling with the bit where you say you "responded to the claim form stating that I disagree with the fine".

How exactly did you respond? Who did you respond to?

Oh... and of course it isn't a fine.

    The fine is for £20.03
    Is that figure correct?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

firstly , i think that figue is wrong probably £100 or £160 , but not £20

now regarding the "van" thing , this is where it gets messy , is the van reg ing your name , ie joe bloggs or is it joe bloggs LTD , if its you , singular , then any court case would be in your local court , if its buisness , they get to choose

why did you not give the hotel grief when you got ticket , i would be speaking to high ups at hotel and getting written conformation that they would have stopped cel as you were a customer

Hi sorry yes it was £275.03 in total

the van is registered to my limited company.

To be honest when the first few letters came through I did think they would just go away after a few threats

Are saying that you wrote something in the Defence and Counterclaim box?

I'll say it again... what exactly did you write? And in which boxes?

The van is registered in my limited companies name. I think the £200 is extra charges they have added from the original charge.
  • the max chargable for a private parking ticket in the UK is £100 , a company can claim back court fees and charge a max of £50 for legal fees

the figure of £275.03 has been highly inflated
by not replying to the parking co and naming a keeper at time of incident  , you have now got cel chasing a ltd company , and the case will be held at THERE local court , not yours
