Thanks everyone for commenting; I am still waiting for my chargeback claim through Tesco credit card, but should I carry out/initiate an S75 claim while I wait in case this fails? Worried about time limits....0

S75 doesn't apply here because you booked through an agent rather than directly with the airline.fivesmaster said:Thanks everyone for commenting; I am still waiting for my chargeback claim through Tesco credit card, but should I carry out/initiate an S75 claim while I wait in case this fails? Thanks for letting me know, I did not realise this. So really this is the only way, through chargeback....worried it will be rejected....eskbanker said:

I was in the same boat, but with BudgetAir.co.uk. My flight was due to go last May but was cancelled by the airline, Kenya Airways. After months and months of hassling both the airline and Bugetair, today I finally got a note that the refund was processing. I had tried to initiate a chargeback via my bank, and on the initial web chat with them, they did not tell me that I couldn't make it because it was the booking agent not the airline, so it may be possible you can do that.
The super annoying thing about my refund is BudgetAir have charged me a cancellation fee and the airline have not refunded a seat booking...both acting like I cancelled the flight, not them! I wondered whether others were to get these fees back as it's a bloody cheek when I've been waiting so long!0 -
I would suspect that this is an admin fee not a cancellation fee, something that they are legally entitled to do, so long as the amount of the fee is "reasonable".heatherh765 said:The super annoying thing about my refund is BudgetAir have charged me a cancellation fee
You should be entitled to have any allocated seat fee refunded.heatherh765 said:the airline have not refunded a seat booking
Some will have got some fees back, but not usually the admin fees and some who initiated chargebacks have been chased for the admin fees as they are legally due. I suspect that with enough chasing you might get the seat allocation charge back, but you need to decide if the money you would get back is worth the time and effort.heatherh765 said:I wondered whether others were to get these fees back as it's a bloody cheek when I've been waiting so long!0 -
Just to be clear, chargeback and section 75 are different processes, and it's only the latter that includes the constraint about having to book directly with the supplier, so using an agent doesn't disqualify a claim if using the chargeback process.heatherh765 said:I had tried to initiate a chargeback via my bank, and on the initial web chat with them, they did not tell me that I couldn't make it because it was the booking agent not the airline, so it may be possible you can do that.1 -
I just wanted to update you all on my position, firstly to thank all those who replied with advice but also to help others in case they find themselves in similar situation; I rang Traveltrolley today for an update and they informed me Tesco's had carried out the chargeback. Super! They also confirmed Vietnam Airlines had also refunded them, soo win win I guess. I will have t check with Tesco this has happened.0

Hi. I’m also long overdue a refund from Oman Air. I paid £6,894 in November 2019 to BYOjet for 4 Oman Air business class seats to Bangkok for last Easter. BYO told me it would take a year, but they’re saying they have no refund from Oman. Seems I have little choice but to wait as ABTA aren’t getting involved as it was a flight-only booking through an agent. I can’t believe it’s the edge case not covered by S75 or other regulations. Nobody tells you this.Oman bat you away as non-direct purchase and agent just says nothings happening. Anyway, anyone got any advice on how I can get this back?0

This site does, it's always made it clear that buying via agents negates s75 coverage:AndrewMartin71 said:I can’t believe it’s the edge case not covered by S75 or other regulations. Nobody tells you this.
