ELMS Legal - Letter Before Claim threating court
Comments

Thank you all I really appreciate it. Today I received a claim form from county court dated 04 Feb 2021.
I will go back over the posts to work out what I need to do now, but I believe respond to money claim and don't include defense so I have extra time to put together.
No I haven't complained to my MP; is this something worth looking at?
Excel have answered when I sent my request to VCS. ELMS are representing VCS, so I'm guessing that means a data breach. If so I will be sure to !!!!!! that to my defence.
What do you think are the strongest things for me to include?0 -
@StopMakingPoorPeoplePay I'd concentrate on dealing with the court claim (this would be from MCOL, a back office processing centre, not an actual court, although they do have access to judges for managing certain situations) for now and leave the MP complaint until after that is done: you will have an outcome from the claim to share with your MP and can make the point of how crap this system of unregulated companies is.

If possible, do not file an AoS before 9th February, but otherwise, there is nothing to be gained by delaying it.To file an AoS, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.Having filed an AoS in a timely manner, you have until 4pm on Tuesday 9th March 2021 to file your Defence. That's over four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute. To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service instructions.Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.4

And should I include that I do not believe the LBC was valid or am I best focusing on other factors?0

The letter says I have 14 days to acknowledge the claim and then defence to court no later than 28 days. Does that sound correct?
