    I’d also prefer to do this without a hearing. Would a hearing still be required if it is a set aside with consent?
  • No, there will be a hearing - all court cases go to a hearing unless they get discontinued by the claimant.
  • This is a set-aside not a claim ... even a set-aside with consent goes to a hearing?

    Put on your N244 that the application is made to the court to be decided without a hearing.  It's one of the questions on the N244 and that's why it's £100 instead of £255.

    What would I need to send with the n244 if it was with consent? I’m assuming I wouldn’t need a witness statement?

    Of course you do.  All the stuff you see in the 2 examples in the NEWBIES thread.  Getting the Judge to agree isn't a shoo-in. 

    You have to meet CPR 13, as is shown in the 2 threads I've linked for everyone to read, in that section of the NEWBIES thread.

  • Of course you need to convince the court.
    That's a requirement. You have to show cpr13.2 or 13.3. Consent just means they're not opposing you. Nothing more. The court still has to decide.
