No, there will be a hearing - all court cases go to a hearing unless they get discontinued by the claimant.

Of course you do. All the stuff you see in the 2 examples in the NEWBIES thread. Getting the Judge to agree isn't a shoo-in.

Of course you need to convince the court.
That's a requirement. You have to show cpr13.2 or 13.3. Consent just means they're not opposing you. Nothing more. The court still has to decide.1
