Notice to Keeper/Owner

A few days ago I received an NTK from APCOA  for a windscreen ticket that was supposedly given in June 2020 but first I knew about was when the NTK arrived in December 2020. The photos on the NTK clearly show that no ticket was stuck to the car. Yes, I own the car but others also drive the car and all say that they did not see any ticket. What should I do?

    Send the blue text template appeal easily found in the first post of the NEWBIES thread.

    Send it unchanged - no additions or alterations needed.

    Send it as the keeper.

  • Sorry if I'm being silly is this the template your both talking about:
    Re PCN number:
    I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.
    There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require an explanation of the allegation and your evidence. You must include a close up actual photograph of the sign you contend was at the location on the material date as well as your images of the vehicle.
    If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it.
    If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner.

    How many blue text templates did you find in the first post of the NEWBIES thread?

    I gave you a link to that thread - should be easy to find what I was talking about.

    Or put it another way...
    If that is the blue text template appeal from the NEWBIES thread, then use it.
    If it is not the blue text template appeal from the NEWBIES thread, then don't use it.

    But it does say "ONE SIZE FITS ALL".

    It really doesn't matter what it says. Your appeal will be either be
    a) recognised as coming from MSE and therefore too difficult and accepted, or
    b) rejected - then won at PoPLA.

    You can add a line if you like, laughing about the fact they took months to send you the NTK and that they've failed to comply with the POFA.  You will win as long as your added line doesn't blow it by going on about who parked! 

    Honestly the keeper could write ANYTHING and still win.  Dead easy.  And please don't come back asking us which option to tick on APCOA's appeal page if it tries to trick people into ticking 'I was the driver'.  Obviously not.
