Completing but letting the seller move out 2 days later. Bad idea?

Would love advice! Our seller can't find a removal company with space on the 18th so we're discussing completing on the 18th and then us moving in/her moving out on the 21st.

We've got a good relationship (she's already let us move in some of our furniture and is leaving a lot of the hers for us) and it would actually suit us better to move on the 21st anyway. The next possible moving date being proposed is the 4th Jan which would be really hard for us both as back at work after the xmas break.

Is this is a bad idea?

    This is a really bad idea - normally you buy with vacant posession, and if you do this, the property wouldn't be vacant - this potentially also affects your mortgage. You should look to complete on the 21st instead. 

    I'd also not be moving my stuff in until I had the keys in my hands following completion.

    Have you exchanged?
    If not, then why not just arrange for completion on the 21st?   Or are they all closed?
    Your solicitor will advise strongly if not insist that you have vacant possession and since they are probably acting for the mortgage company as well as yourselves then they can insist even if you want to proceed against advice.

    Thanks for your answers. What is the issue with it not being vacant and how would it affect our mortgage? Sorry, FTB and finding it all difficult to understand...
    I will ask about the 21st. The estate agent sales progressor seemed convinced it had to be the 18th otherwise would be January.

    Because you (and your lender) don't want some third party squatting in the property. There is no quick or easy way of getting rid of them if they don't leave when you expect them to.

    Why not complete on the 21st? 
  • Sounds like the EA just CBA and wants an easy fix to me.
    Give them either 21st or whatever date in January is most convenient for you. Ether way it’s NYFP and they need to JFDI ASAP.

  • There are all sorts of legal reasons not to do this.
    Speak to your solicitor. He''l give you the same answer and very firmly.

    I understand JFDI, but NYFP????? 

    Even google doesn't seem to know. Something to do with New York, perhaps?
